PRAKASH TATIA, J.\n<\/pre>\n<p>Mr.Pramendra Bohra, for the petitioner.\n<\/p>\n<p>                          &#8211; &#8211; &#8211; &#8211; &#8211;\n<\/p>\n<p>      Heard learned counsel for the petitioner.\n<\/p>\n<p>      The petitioner was compulsorily retired vide<br \/>\norder dated 28.11.2000. The petitioner challenged<br \/>\nthe   said   order   by   preferring     appeal   before   the<br \/>\nRajasthan Civil Services Appellate Tribunal which<br \/>\nwas dismissed vide order dated 19.4.2002. Then,<br \/>\nthe petitioner preferred SB Civil Writ Petition<br \/>\nNo.3869\/2002 before this Court which was partly<br \/>\nallowed and the Tribunal&#8217;s order dated 19.4.2002<br \/>\nwas set aside and the matter was remanded to the<br \/>\nTribunal     for   deciding   the     appeal   afresh   after<br \/>\ntaking into consideration the grounds taken by the<br \/>\npetitioner with regard to the competence of the<br \/>\nauthority     passing      the       order   of   compulsory<br \/>\nretirement for the post of A.S.I. as well as the<br \/>\nfact of promotion of the petitioner and the ACARs<br \/>\nof the petitioner for four years.\n<\/p>\n<p><span class=\"hidden_text\">                                         2<\/span><\/p>\n<p>       The    Tribunal       after      remand      vide      order     dated<br \/>\n4.11.2009          dismissed        the        petitioner&#8217;s         appeal.<br \/>\nHence, this second round of litigation before this<br \/>\nCourt.\n<\/p>\n<p>       Learned counsel for the petitioner vehemently<br \/>\nsubmitted          that    the    petitioner          was    promoted     on<br \/>\nhigher post. His ACRs of past five years were good<br \/>\nor outstanding as well as very good and in view of<br \/>\nthe above reason, the petitioner could not have<br \/>\nbeen made to retire compulsorily.\n<\/p>\n<p>       I     considered          the        submissions       of    learned<br \/>\ncounsel for the petitioner and perused the facts<br \/>\nof the case.\n<\/p>\n<p>       The Tribunal has considered the petitioner&#8217;s<br \/>\nservice          record      and       found       the       petitioner&#8217;s<br \/>\ncompulsorily              retirement           justified           as    the<br \/>\npetitioner was punished even after promotion in<br \/>\nthe year 1995 with one year&#8217;s stoppage of wages,<br \/>\nwith       punishment      of    censure,         with      punishment     of<br \/>\nstoppage of one grade increment, then for censure,<br \/>\nagain      for     censure,      then       two   senior      officers     in<br \/>\ninternal         report     found       that      the    petitioner       was<br \/>\ninvolved in bribery and taking liquor and he in<br \/>\ntotal        was     punished          17     times      under      various<br \/>\nmisconducts.\n<\/p>\n<p>       In view of the above, I do not find that there<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>can    be    any   justification   for     allowing     the<br \/>\npetitioner    to   invoke   equitable    jurisdiction   of<br \/>\nthis Court under Article 226 of the Constitution<br \/>\nof India and further his case has been considered<br \/>\nby the Tribunal twice on facts.\n<\/p>\n<p>      Consequently, this writ petition, having no<br \/>\nmerits, is hereby dismissed.\n<\/p>\n<p>                                   (PRAKASH TATIA), J.\n<\/p>\n<p>S.Phophaliya\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Mangi Lal vs State Of Raj. &amp; Ors on 10 February, 2010 1 S.B.
