JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 19\/07\/2011  \nORAL ORDER<\/pre>\n<p>1.\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled with the following prayers:-\n<\/p>\n<p>&#8220;(A)\tYour<br \/>\nLordships will be pleased to issue a Writ of Mandamus, or any other<br \/>\nappropriate Writ, Order or direction, quashing and setting aside the<br \/>\norder no.2 of 2011<br \/>\nat  Annexure-&#8220;F&#8221;\n<\/p>\n<p>passed by the respondent no.3.\n<\/p>\n<p>(B)\tPending<br \/>\nthe hearing and final disposal of this petition Your Lordships be<br \/>\npleased to grant an interim relief and direct the respondent no.3 to<br \/>\nrelease the said vehicle forthwith;\n<\/p>\n<p>(C)\tAny<br \/>\nother and further relief as this Hon&#8217;ble Court may deem fit and<br \/>\nproper in the facts and circumstances of the case be granted.&#8221;\n<\/p>\n<p>2.\tWhen<br \/>\nthe matter is taken up today, Mr.Jitendra Singh, learned advocate for<br \/>\nthe petitioner, states that he may be permitted to withdraw the<br \/>\npetition  with a view to availing of the statutory remedy before the<br \/>\nAppellate Authority. However, some directions may be issued regarding<br \/>\nexpeditious disposal of the appeal.\n<\/p>\n<p>3.\tUpon<br \/>\nthe above statement being made by the learned advocate for the<br \/>\npetitioner, the following order is passed:-\n<\/p>\n<p>\tIn<br \/>\nthe event that the petitioner files an appeal against the impugned<br \/>\norder before the Appellate Authority, the said Authority shall<br \/>\nconsider and decide the same, in accordance with law, within a period<br \/>\nof fifteen days from the date of filing of the appeal as the period<br \/>\nfor which the licence has been suspended is to expire on 20.08.2011.\n<\/p>\n<p>\tSubject<br \/>\nto the above directions, permission to withdraw the petition is<br \/>\ngranted.
