Therefore, the complaint for sale was being<br \/>\n\tfiled by the complainant.  Under these circumstances, the applicant<br \/>\n\thas approached to this Court for quashing of the said complaint.\n<\/p>\n<p>Considering<br \/>\n\tthe allegation made in the complaint that the share certificate is<br \/>\n\tnot genuine and bogus as per the report received from the concerned<br \/>\n\tCompany, the investigation would be required to be undertaken with<br \/>\n\tthe help of the expert and it cannot be said that if the contents of<br \/>\n\tcomplaint are considered as it is, it would not constitute any<br \/>\n\toffence. Under these circumstances, it would not be a case for<br \/>\n\tquashing of the complaint in exercise of the power under section 482<br \/>\n\tof the CRPC.\n<\/p>\n<p>Mr.Naik,<br \/>\n\tlearned counsel appearing for the petitioner did contend that the<br \/>\n\tpetitioner had only signed as the witness, therefore, the complaint<br \/>\n\tagainst him cannot be maintained.\n<\/p>\n<p>In<br \/>\n\tmy view, such aspects would be essentially a matter of investigation<br \/>\n\tabout the role by the petitioner accused, whether as was that of a<br \/>\n\tmere witness or who sold the shares to the complainant.  The<br \/>\n\taccusation in the complaint is that the shares were given by the<br \/>\n\taccused-complainant for sale, therefore, when such aspect is yet to<br \/>\n\tbe investigated, the mere signature of the applicant as witness in<br \/>\n\tthe transfer form would not be sufficient ground to quash the<br \/>\n\tcomplaint.\n<\/p>\n<p>In<br \/>\n\tview of the above, the petition is meritless, hence, dismissed.<br \/>\n\tRule discharged.   I.R.
