JUSTICE MAHESH BHAGWATI<\/p>\n<p>Mr. Sanjay Kumar Sharma, for accused petitioner.\n<\/p>\n<p>Mr. G.S. Fauzdar, Public Prosecutor, for State.\n<\/p>\n<p>\t\tThis order governs the disposal of bail petition filed under section 439 of Cr.P.C. by Mr. Sanjay Kumar Sharma Advocate on behalf of the applicants pertaining to FIR No.115\/2009 of Police Station Manoharthana, District Jhalawar in the offences under sections 363, 366 and 376\/34 of IPC.\n<\/p>\n<p>2.\t\tHeard the learned counsel for the petitioners as also the learned Public Prosecutor for the State and perused the relevant material available on record.\n<\/p>\n<p>3.\t\tLearned counsel for the petitioners has canvassed that the main accused of this case are Raju and Girdhari and out of these two, Girdhari is alleged to have ravished the prosecutrix without her consent. So far as, the petitioners are concerned, they have been falsely implicated and are in no way connected with the commission of the offence of the instant case. Hence, they may be granted indulgence of bail.\n<\/p>\n<p>4.\t\tLearned Public Prosecutor has opposed the bail petition.\n<\/p>\n<p>5.\t\tHaving considered the submissions made  at the Bar and perused the relevant material available on record, I, without expressing any opinion on the merits of the case, do feel inclined to  grant bail to  the petitioners and the bail petition is ordered to be allowed.\n<\/p>\n<p>6.\t\tIt is, therefore, ordered that the accused petitioners namely Laxmi Narayan S\/o. Jagannath; and Bansilal S\/o.
