JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/10\/2010 \n\n \n\nCOMMON\nORAL ORDER<\/pre>\n<p>(Per :\n<\/p>\n<p>HONOURABLE MR.JUSTICE D.H.WAGHELA)<\/p>\n<p>1.\tHaving<br \/>\nheard learned counsel on both sides, the petitions are admitted and<br \/>\nnotice of Rule is waived by learned counsel appearing on both sides<br \/>\nsince the impugned order is common in both the petitions.\n<\/p>\n<p>2.\tSince<br \/>\nthe cooperative Society, i.e. Shri Sakra Sewa Sahakari Mandali<br \/>\nLimited, has relied upon the order dated 04.01.2008 for its revival<br \/>\nby the order of District Registrar, Cooperative Societies, Patan, and<br \/>\nthat order appears to have been made under the provisions of Section<br \/>\n19 of the Gujarat Cooperative Societies Act, 1961 (a copy of which is<br \/>\nplaced and taken on record); and as the Society is stated to be<br \/>\nfunctioning as per the Resolution made for the purpose of its<br \/>\nrevival, learned counsel for the Society is directed to file detailed<br \/>\naffidavit in respect of the working of the Society after its revival,<br \/>\nannexing the audited and unaudited annual accounts of the Society and<br \/>\nlearned counsel for the Registrar is directed to file an affidavit,<br \/>\nexplaining and justifying the order dated 04.01.2008 of revival,<br \/>\nannexing with it, the record considered at the time of ordering<br \/>\nrevival of the Society.\n<\/p>\n<p>3.\tThe<br \/>\npetitions are ordered to be listed on the admission Board on<br \/>\n27.10.2010, as far as practicable for final disposal.\n<\/p>\n<p>\t\t\t\t\t\t\t(D.H.Waghela,<br \/>\nJ.)<\/p>\n<p>  (Smt.Abhilasha Kumari, J.)<\/p>\n<p>(sunil)<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Desai vs State on 20 October, 2010 Author: D.H.Waghela,&amp;Nbsp;Honble Smt.
