Pleader<\/p>\n<p>^For Respondents  &#8230; Mr.V.Radhakrishnan,<br \/>\n\t\t\tSenior Counsel for<br \/>\n\t\t\tMr.S.Kadarkarai<br \/>\n\t\t\tfor R.1 to R.7<\/p>\n<p>:COMMON JUDGMENT<\/p>\n<p>\tThe Government filed the appeals in A.S.Nos.650 of 1997, 454 of 2001 and<br \/>\n94 2006 to get set aside the judgment and decree passed in L.A.O.P.Nos.95 of<br \/>\n1989, 68 of 1988 and 69 of 1988, dated 26.06.1996, by the learned Subordinate<br \/>\nJudge, Srivilliputtur.\n<\/p>\n<p>\t2. Heard both sides.\n<\/p>\n<p>\t3. A re&#8217;sume&#8217; of facts absolutely necessary and germane for the disposal<br \/>\nof these appeals would run thus:\n<\/p>\n<p>\tThe notification under Section 4(1) of the Land Acquisition Act, dated<br \/>\n25.09.1985, was made relating  to acquiring of the lands involved in the<br \/>\nfollowing cases:\n<\/p>\n<p>Sl.No.\n<\/p>\n<p>A.S.Nos.\n<\/p>\n<p>Award No.&amp; Dated<br \/>\nLand Value Fixed by the Sub Judge, Srivilliputtur<br \/>\n(Per Cent)\n<\/p>\n<p>1.<br \/>\n650 of 1997<br \/>\n2\/88-\n<\/p>\n<p>19.10.1988<br \/>\nRs.1,300\/-\n<\/p>\n<p>2.<br \/>\n454 of 1997<br \/>\n1\/88-\n<\/p>\n<p>19.01.1988<br \/>\nRs.1,300\/-\n<\/p>\n<p>3.<br \/>\n94 of 2006<br \/>\n<span class=\"hidden_text\">1\/88<\/span><br \/>\n19.11.1988<br \/>\nRs.1,300\/-\n<\/p>\n<p>for acquiring a vast tract of land under the &#8220;Neighbourhood Development Scheme&#8221;,<br \/>\nSivakasi.  Consequently, necessary steps were taken as per law for acquiring the<br \/>\nlands and ultimately, the relevant awards emerged.\n<\/p>\n<p>\t4. The land acquisition officer assessed the compensation in a sum of<br \/>\nRs.11,115\/- per Hectare.\n<\/p>\n<p>\t5. Being aggrieved by and dissatisfied with, such passing of awards,<br \/>\nquantifying the compensation, various references under Section 18 of the Land<br \/>\nAcquisition Act, have been made to the Sub Judge, Srivilliputtur.  Consequently,<br \/>\nthe Sub Judge assessed the value of the land and ultimately,  enhanced the<br \/>\ncompensation to the tune of Rs.1,300\/- (Rupees One Thousand and Three Hundred<br \/>\nonly) per cent from the one assessed by the Land Acquisition Officer, placing<br \/>\nreliance on Ex.A.3, the deed filed before the Court.\n<\/p>\n<p>\t6. Challenging the same, the Government preferred the aforesaid appeals on<br \/>\nthe ground that the Sub Court granted excessive compensation.\n<\/p>\n<p>\t7. The background of these cases could be portrayed thus:\n<\/p>\n<p>\tUnassailably and incontrovertibly, on earlier occasions, in various other<br \/>\nmatters, connected with the same Section 4(1) notification, awards were passed<br \/>\nby the Division Bench of this Court.  One such appeal is A.S.No.517 of 1997,<br \/>\nwherein this Court adopted the value of compensation as fixed in A.S.No.468 of<br \/>\n1993 assessing the compensation at Rs.1,200\/- per cent, over which Special Leave<br \/>\nto Appeal(Civil).No.8660 of 2001, was filed by the Government which was<br \/>\ndismissed in liminie.\n<\/p>\n<p>\t8. Accordingly, the learned Senior Counsel for the claimants would<br \/>\njustifiably pray for following the earlier decision of the Division Bench of<br \/>\nthis Court and for passing necessary orders.\n<\/p>\n<p>\t9. The learned Government Pleader would agree to the factual position.\n<\/p>\n<p>\t10. Perused the earlier order of the Division Bench of this Court in<br \/>\nA.S.No.517 of 1997 dated 30.09.2002 and it is found that the compensation<br \/>\ntowards the land was fixed at Rs.1,200\/- per cent.  It is quite obvious that but<br \/>\nfor this land acquisition, the lands acquired might have got developed into<br \/>\nhousing plots and that would have fetched very good sale consideration.\n<\/p>\n<p>\t11. Considering all these facts alone, earlier Division Bench of this<br \/>\nCourt awarded the compensation at Rs.1,200\/- per cent and I am having no reason<br \/>\nto differ from the view already taken by this Court.\n<\/p>\n<p>\t12. Accordingly, the net value of the land for awarding compensation is<br \/>\narrived at Rs.1,200\/- per cent (Rupees One Thousand and Two Hundred only).<br \/>\nHence, if worked out, the net value of the land per acre would come to<br \/>\nRs.1,20,000\/-(Rupees One Lakh and Twenty Thousand only).\n<\/p>\n<p>\t13. The claimants are also entitled to statutory entitlements over which<br \/>\nthere is no dispute.  For the enhanced amount in the award, the claimants are<br \/>\nentitled to get solatium as well as interest.\n<\/p>\n<p>\t14. The learned Counsel for the claimants cited the decision of the<br \/>\nDivision Bench of this Court in <a href=\"\/doc\/1819036\/\">Sub Collector, Padmanabhapuram v. R.S.Raveendran<\/a><br \/>\nreported in 2006-2-L.W.102 and an excerpt from it, would run thus:<br \/>\n\t&#8220;10.It is also relevant to note that Section 53 of the Land Acquisition<br \/>\nAct, 1894 makes it clear that the provisions of Code of Civil Procedure, 1908<br \/>\nare  applicable to all proceedings initiated under the said Act (Land<br \/>\nAcquisition Act).  In view of the same, it is not in dispute that Order 41, Rule<br \/>\n33 C.P.C. is applicable to the land acquisition proceedings.  Inasmuch as the<br \/>\nappeal is also continuation of the original proceedings, the said provisions are<br \/>\napplicable to the appeals also and in view of the law laid down by the Apex<br \/>\nCourt as well as this Court in <a href=\"\/doc\/531626\/\">Sunder v. Union of India,<\/a> interest is payable for<br \/>\nthe solatium amount, and in order to render substantial justice, we accept the<br \/>\nrequest of the counsel for respondents\/claimants and hold that the solatium<br \/>\namount also carries interest at the same rate as applicable to the enhanced<br \/>\ncompensation and additional amount.&#8221;\n<\/p>\n<p>\t15. As such, adhering to the aforesaid decision, the claimants are<br \/>\nentitled to appropriate interest on the solatium as well as the additional<br \/>\namount awarded.  The Government shall deposit the amount in the interest of both<br \/>\nsides within a period of six months from this date.   Accordingly, all the<br \/>\nappeals are disposed of by this common judgment.
