 under Section 24 of CPC to transfer<\/p>\n

 p”‘\u00a2cHfifp”.,’Ne.8. wherein O.S.No.6340\/97 is pending or<\/p>\n

Bangalore. Aggrieved, the plaintiff in O.S.No\u00ab. <\/p>\n
filed these writ petitions.\n<\/p>\n

4. The learned .i?1’il.”.__VV\u00bb  Judge has
\nmisdirected  gin   impugned order
\nrefusing to. one and the same Court
\non three   by; making a reference to the<\/p>\n
record of   and hoiding that the suit<\/p>\n
seheduie prope1jty’in thewtwo suits are different. Secondly,<\/p>\n
 i\ufb02vthat”;    at different stages, there is no<\/p>\n
 t.o-grant the relief. Thirdly, in View of the<\/p>\n
 _ rejection”of-JViisc.23\/O6. the petition is not tenable.<\/p>\n
if u _  Section 24 of CPC is with regard to the general<\/p>\n
 power of transfer and Withdrawal. Sub–section (1) thereof<\/p>\n

 can be withdrawn and made over for trial<\/p>\n

dismissal of an earlier petition i.e., Misc.23\/O6 does not<\/p>\n
operate as res judicata. Depending uporil’<\/p>\n
