Whether the judgment should be reported in the Digest?\nPRADEEP NANDRAJOG, J.\n<\/pre>\n<p>1.     Heard learned counsel for the petitioner and perused the<br \/>\nrecord.\n<\/p>\n<p>2.     Of the various averments made in the writ petition and<br \/>\ngrounds urged in support of the prayer, learned counsel urges<br \/>\nthat there is no evidence to sustain the first and second charge.<br \/>\nCounsel highlights that 5 witnesses of the prosecution have<br \/>\ndeposed only with respect to Charge No.III.\n<\/p>\n<p>3.     Counsel urges that the verdict of guilt at the Summary<br \/>\nSecurity Force Court Trial returns petitioner guilty of all 3<br \/>\ncharges and penalty imposed is of dismissal from service. It is<br \/>\nurged that the penalty has to be set aside for the reason it is<br \/>\npremised as if petitioner is guilty of all 3 charges.\n<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 6988\/2001                                          Page 1 of 6<\/span><\/p>\n<p> 4.     Alternate submission made is that if all 3 charges stand<br \/>\nproved, penalty of dismissal from service is disproportionate to<br \/>\nthe gravity of offences.\n<\/p>\n<p>5.     3 charges on which the petitioner was tried at the<br \/>\nSummary Security Force Court Trial reads as under:-\n<\/p>\n<blockquote><p>       &#8220;The accused No.89401396 Const.Sher Singh of \u201eC\u201f Coy.5<br \/>\n       Bn BSF is charged with:-<\/p><\/blockquote>\n<pre>\n\n       IST CHARGE       DISOBEYING IN SUCH MANNER AS TO\n       BSF ACR          SHOW A WILFUL DEFIANCE OF\n       SECTION 21(1)    AUTHORITY, A LAWFUL COMMAND GIVEN\n<\/pre>\n<blockquote><p>                        PERONALLY BY HIS SUPERIOR OFFICER IN<br \/>\n                        THE EXECUTION OF HIS OFFICE.\n<\/p><\/blockquote>\n<blockquote><p>                        in that he,<\/p>\n<p>                        while undergoing 14 days RI given by Shri<br \/>\n                        N.D.Bahuguna, Offg.Comdt, 5 Bn BSF on<br \/>\n                        31.12.99 for having committed an offence<br \/>\n                        of absenting himself without leave<br \/>\n                        punishable U\/S 19(a) of the BSF Act, on<br \/>\n                        1.1.2000 when ordered by No.85102980<br \/>\n                        HC V.B.Karjagi, duty NCO of that day, to<br \/>\n                        carry out pack drill, denied saying &#8220;MAIN<br \/>\n                        ISS SAJJA KO NAHIN MANTA AUR PACK<br \/>\n                        DRILL NAHIN TAHLUNGA&#8221; and words to<br \/>\n                        this effect, and did not carry out the pack<br \/>\n                        drill and thereby disobeyed the orders<br \/>\n                        given by his superior officer.<\/p><\/blockquote>\n<pre>\n\n\n       IIND CHARGE      DISOBEYING IN SUCH MANNER AS TO\n       BSF ACT          SHOW     A   WILFUL    DEFIANCE OF\n       SEC-21(1)        AUTHORITY, A LAWFUL COMMAND GIVEN\n<\/pre>\n<blockquote><p>                        PERSONALLY BY HIS SUPERIOR OFFICER<br \/>\n                        IN THE EXECUTION OF HIS OFFICE<\/p>\n<p>                        in that he,<\/p>\n<p>                        on being released from the Quarter Guard<br \/>\n                        on completion of 14 days RI given to him,<br \/>\n                        when ordered by No.75001299 HC Ram<br \/>\n<span class=\"hidden_text\">W.P.(C) No. 6988\/2001                                    Page 2 of 6<\/span><br \/>\n                            Pal Singh on 14.1.2000 to take his<br \/>\n                           uniform belt and cap, arrogantly refused<br \/>\n                           to take over his belt and cap.<\/p><\/blockquote>\n<pre>\n\n\n       III RD CHARGE       ABSENTING HIMSELF WITHOUT LEAVE\n       BSF ACT\n       SEC-19(A)           in that he,\n\n<\/pre>\n<blockquote><p>                           at Bn HQ (Sunderbani), J&amp;K on 26.3.2000<br \/>\n                           absented himself without leave and<br \/>\n                           reported voluntarily on 22.6.2000 (AN).\n<\/p><\/blockquote>\n<blockquote><p>                           Total period of absence w.e.f. 26.3.2000<br \/>\n                           to 22.6.2000 (AN) for 89 days.\n<\/p><\/blockquote>\n<blockquote><p>                                                              (D.S.RATHORE)<br \/>\n                                                               COMMANDANT<br \/>\n                                                                5th Bn. B.S.F.\n<\/p><\/blockquote>\n<blockquote><p>       6.     The original record of the trial produced would reveal<br \/>\n       that SI\/RM Joginder Ram PW-1, HC Ranbir Singh PW-2, HC<br \/>\n       V.B.Karjagi PW-3 and SI S.D.Sharma PW-4 deposed with<br \/>\n       respect     to   Article   I    of     the   charge.   The   testimony<br \/>\n       establishes that while undergoing 14 days RI, required to<br \/>\n       carry out pack drill, petitioner refused saying that he does<br \/>\n       not accept the punishment.\n<\/p><\/blockquote>\n<blockquote><p>       7.     Pertaining to the second charge, HC Ram Pal Singh<br \/>\n       PW-1, Ct.P.K.Hazarika PW-2, Shri N.D.Bahuguna PW-3<br \/>\n       deposed with respect to Charge No.II and their evidences<br \/>\n       establish that the petitioner refused to take his uniform<br \/>\n       belt and cap after he completed 14 days RI and the refusal<br \/>\n       was in an arrogant manner.\n<\/p><\/blockquote>\n<blockquote><p>       8.     Record further shows that HC Dalip Singh PW-1,<br \/>\n       Ct.Rajinder      Narjary       PW-2,    SI   Sangram    Singh    PW-3,<br \/>\n       Ct.Krishan Lal PW-4 and SI S.D.Sharma PW-5 have deposed<br \/>\n       with respect to the 3rd charge and we highlight that their<br \/>\n<span class=\"hidden_text\">W.P.(C) No. 6988\/2001                                               Page 3 of 6<\/span><br \/>\n        testimony establishes that the petitioner had absented<br \/>\n       himself without leave as alleged as per the 3rd charge.\n<\/p><\/blockquote>\n<blockquote><p>       9.     Thus, the argument that the first 2 charges have<br \/>\n       been held established without any evidence is incorrect.\n<\/p><\/blockquote>\n<blockquote><p>       10.    It appears that          the basis     of   the plea is the<br \/>\n       Commandant of the Unit who acted as the Court, listing<br \/>\n       the various prosecution witnesses as PW-1 onwards<br \/>\n       separately for each charge.\n<\/p><\/blockquote>\n<blockquote><p>       11.    On the issue of the proportionality of the sentence,<br \/>\n       record shows that this was not the first misdemeanor<br \/>\n       which was detected.\n<\/p><\/blockquote>\n<blockquote><p>       12.    The       petitioner   had    11   years    service     and    was<br \/>\n       penalized twice. Once for unauthorisedly possessing 8<br \/>\n       bottles of rum for which 14 days RI was inflicted on<br \/>\n       22.10.1991.          Second      punishment        was       for     being<br \/>\n       unauthorized absence for 9 days and for which 7 days<br \/>\n       extra duty as a penalty was inflicted apart from 14 days RI.\n<\/p><\/blockquote>\n<blockquote><p>       13.    Record       shows     that   on   3   occasions      petitioner\u201fs<br \/>\n       unauthorized absence was condoned and regularised.\n<\/p><\/blockquote>\n<blockquote><p>       14.    ACR record of the petitioner is also not very healthy.<br \/>\n       An adverse remark has been entered for the year 1997<br \/>\n       that petitioner was careless, talkative, disobedient and a<br \/>\n       habitual drinker, and that except for drawing salary he had<br \/>\n       no inclination to work. For the year 2000, the adverse<br \/>\n       entry recorded is that the petitioner is a disobedient<br \/>\n       soldier. He does not obey the command of the seniors and<br \/>\n       enters into a verbal quarrel. He is a habitual drinker and<br \/>\n       was not recommended for promotion.\n<\/p><\/blockquote>\n<blockquote><p>       15.    It is settled law that past conduct can always be<br \/>\n       considered on the issue of proportionality of the penalty<br \/>\n<span class=\"hidden_text\">W.P.(C) No. 6988\/2001                                                 Page 4 of 6<\/span><br \/>\n        imposed.\n<\/p><\/blockquote>\n<blockquote><p>       16.    At this stage, learned counsel for the petitioner prays<br \/>\n       that since the petitioner has a family consisting of 3 minor<br \/>\n       children, notwithstanding penalty of dismissal from service<br \/>\n       being inflicted, it may be directed that in terms of Rule 41<br \/>\n       of the CCS (Pension) Rules, a compassionate allowance be<br \/>\n       sanctioned and be paid to the petitioner.\n<\/p><\/blockquote>\n<blockquote><p>       17.    We note that as per the mandate of Rule 24 of the<br \/>\n       CCS (Pension) Rules, dismissal or removal of a government<br \/>\n       servant from service or post entails forfeiture of past<br \/>\n       service, and so is the mandate of sub-rule 1 of Rule 41, but<br \/>\n       the proviso thereof empowers the Competent Authority,<br \/>\n       who has dismissed or removed from service a government<br \/>\n       servant may sanction a compensation pension.\n<\/p><\/blockquote>\n<blockquote><p>       18.    While dismissing the writ petition without any order<br \/>\n       as to costs, we observe that if the petitioner makes a<br \/>\n       representation to the Competent Authority who has<br \/>\n       dismissed        the petitioner from    service,   the authority<br \/>\n       concerned would consider the request in terms of the<br \/>\n       proviso to sub-rule 1 of Rule 41 of the CCS (Pension) Rules<br \/>\n       and if it is opined that it is a deserving case or there are<br \/>\n       special circumstances, i.e. a case is made out within the<br \/>\n       proviso to sub-rule 1 of Rule 41 of CCS (Pension) Rules,<br \/>\n       compensation pension would be disbursed.\n<\/p><\/blockquote>\n<blockquote><p>       19.    If the petitioner were to make a representation as<br \/>\n       aforesaid,       necessary   decision   would   be   taken    and<br \/>\n       conveyed to the petitioner within 6 weeks and if request is<br \/>\n       accepted, compensation pension would be disbursed as<br \/>\n       per the Rules.\n<\/p><\/blockquote>\n<blockquote><p>       20.
