Present respondents have filed Regular<br \/>\n\tCivil Suit No.15 of 2008 before the learned Principal Civil Judge,<br \/>\n\tSanand against the present applicant. In the said suit, applicants<br \/>\n\tfiled application Exh.14 under Order 7 Rule 11(a) and (d) read with<br \/>\n\tSection 151 of Civil Procedure Code and prayed that the plaint be<br \/>\n\trejected. It is this application which came to be dismissed by the<br \/>\n\timpugned order dated 12.6.2008.\n<\/p>\n<p>Learned<br \/>\n\tadvocate, Shri Memon, for the applicants vehemently urged that the<br \/>\n\tsuit does not disclose any cause of action and that the same is<br \/>\n\tbarred by law. Civil Court, therefore, erred in dismissing the<br \/>\n\tapplication filed under Order 7 Rule 11(a) and (d).\n<\/p>\n<p>2.1\tHe<br \/>\n\tplaces reliance on the decision of T.Arivandandam V\/s. Satyapal<br \/>\n\tand another reported in AIR 1977, SC 2421 wherein, referring to<br \/>\n\tthe provisions made in Order 7 Rule 11, the Apex Court observed that<br \/>\n\tCourt should find out reading the plaint whether it is manifestly<br \/>\n\tvexatious and meritless, in the sense of not disclosing a clear<br \/>\n\tright to sue.\n<\/p>\n<p>2.2\tReliance<br \/>\n\twas placed on the decision of the Apex Court in the case of Mehar<br \/>\n\tChand Das V\/s. Lal Babu Siddique &amp; Ors. reported in AIR 2007<br \/>\n\tSC 1499; wherein, Apex Court reiterated that mere suit for<br \/>\n\tdeclaration without claiming relief of possession is not tenable.\n<\/p>\n<p>2.3\tReliance<br \/>\n\twas also placed any the decision of leaned Single Judge of this<br \/>\n\tCourt reported in the case of Ishwarbhai alias Batukbhai L.Shah<br \/>\n\tV\/s. Bhanushali Hiralal Mohanlal Nanda reported in AIR 2002<br \/>\n\tGujarat 328. The said decision is, however, concerned with question<br \/>\n\tof interim injunction that can be granted in suit for specific<br \/>\n\tperformance of agreement. Observations made therein would not have<br \/>\n\tin my view, any application in the present case.\n<\/p>\n<p>Learned<br \/>\n\tadvocate Shri P.R.Nanavati for the respondents however, opposed the<br \/>\n\tpetition and submitted that impugned order suffers from no<br \/>\n\tillegality.\n<\/p>\n<p>Having<br \/>\n\theard the learned advocates and having perused the documents on<br \/>\n\trecord, it clearly emerges that plaintiff has filed the suit<br \/>\n\tcontending inter-alia that as owners of the suit land are in actual<br \/>\n\tpossession thereof. However, names of the defendants have been<br \/>\n\tentered into revenue records by mistake. Procedure deleting the<br \/>\n\tnames has been initiated during which time, the defendants are<br \/>\n\tthreatening to enter the suit land and are attempting to put up<br \/>\n\tconstruction thereon illegally. In this background, the plaintiffs<br \/>\n\thave prayed that the Court may declare that the defendants have no<br \/>\n\tright, title or interest over the suit land. They have also prayed<br \/>\n\tthat the defendants be permanently injuncted from entering the suit<br \/>\n\tland or disturbing the possession of the suit land of the<br \/>\n\tplaintiffs, through their servants, agents, etc.<\/p>\n<p>Reading<br \/>\n\tthe plaint as a whole, I do not find that the same does not disclose<br \/>\n\tany cause of action or that the same is barred by any law. What<br \/>\n\trelief can be ultimately granted has to be judged on the basis of<br \/>\n\tevidence that may be brought on record. This, however, certainly<br \/>\n\twould not be a case for exercising powers under Order 7 Rule 11.\n<\/p>\n<p>The<br \/>\n\tcontention that the interim-relief prayed in the Exh.5 application<br \/>\n\tis not relatable to the final result claimed in the suit can at best<br \/>\n\tbe arguments at the stage of hearing of interim injunction<br \/>\n\tapplication and not for dismissal of the suit itself.\n<\/p>\n<p>Under<br \/>\n\tthe circumstances, revision application is dismissed. Notice is<br \/>\n\tdischarged.
