NIVA DEVI WIFE OF LATE SUDHIR KUMAR SRIVASTAVA\n         4.   MAMTA DEVI WIFE OF PRABHAT KUMAR ALIAS PAPPU\n                                Versus\n                            STATE OF BIHAR\n                             -----------\n<\/pre>\n<p>3.   21.12.2010.             This has come at the instance of<\/p>\n<p>                   the learned counsel for the petitioners.<\/p>\n<p>                             By order dated 6.10.2010 passed<\/p>\n<p>                   in this case, bail was granted to the<\/p>\n<p>                   petitioners. However, inadvertently, due<\/p>\n<p>                   to     typographical        mistake,        name     of<\/p>\n<p>                   petitioner no.4, namely, Mamta Devi wife<\/p>\n<p>                   of Prabhat Kumar alias Pappu, resident<\/p>\n<p>                   of Mohalla-Ishlampur, P.s.Town, District<\/p>\n<p>                   Muzaffarpur was neither mentioned in the<\/p>\n<p>                   cause title nor in the operative portion<\/p>\n<p>                   of the order.\n<\/p>\n<pre>                             Regard       being        had      to     the\n\n                   circumstances,        let     the        order    dated\n\n<\/pre>\n<p>                   6.10.2010 be modified to read as follows<\/p>\n<p>                   and    shall    be     deemed       to     have    been<\/p>\n<p>                   pronounced as such.\n<\/p>\n<p>                             &#8220;Heard learned counsel appearing<\/p>\n<p>                   on    behalf   of    the    petitioners      and    the<\/p>\n<p>                   learned counsel appearing on behalf of<\/p>\n<p>                   the State.\n<\/p>\n<p><span class=\"hidden_text\">                       2<\/span><\/p>\n<p>             Petitioners           are         apprehending<\/p>\n<p>their arrest in connection with Sakara<\/p>\n<p>P.S.Case No.431 of 2009 for the offence<\/p>\n<p>punishable under Sections 304B, 328 and<\/p>\n<p>34 of the Indian Penal Code.\n<\/p>\n<p>             Taking       into     consideration           the<\/p>\n<p>submissions of the learned counsel for<\/p>\n<p>the    petitioners          that        the     police    has<\/p>\n<p>submitted charge-sheet only against the<\/p>\n<p>husband      under        Sections       306,    201\/34     of<\/p>\n<p>the    Indian      Penal         Code     and     that     the<\/p>\n<p>husband has been granted regular bail by<\/p>\n<p>a      Bench          of          this          Court       in<\/p>\n<p>Cr.Misc.No.18241            of     2010         vide     order<\/p>\n<p>passed       on    26.5.2010             and     that     the<\/p>\n<p>petitioner        No.1      is    the     father-in-law,<\/p>\n<p>the    petitioner         no.2     mother-in-law,          the<\/p>\n<p>petitioner no.3 the widowed daughter-in-<\/p>\n<p>law and the petitioner no.4 the married<\/p>\n<p>daughter of the petitioner Nos.1 and 2,<\/p>\n<p>let    the     petitioners           namely,       Satyadeo<\/p>\n<p>Prasad, Asha Devi, Niva Devi and Mamta<\/p>\n<p>Devi, in the event of their arrest or<\/p>\n<p>surrender within a period of four weeks<\/p>\n<p>from the date of receipt\/production of a<\/p>\n<p>copy    of    this        order    before        the     Court<br \/>\n<span class=\"hidden_text\">                          3<\/span><\/p>\n<p>      below, be released on bail upon each of<\/p>\n<p>      them individually furnishing bail bonds<\/p>\n<p>      of Rs.10,000\/- (ten thousand) with two<\/p>\n<p>      sureties of the like amount each to the<\/p>\n<p>      satisfaction       of    the     Chief       Judicial<\/p>\n<p>      Magistrate,      Muzaffarpur      in     connection<\/p>\n<p>      with     Sakra     P.S.Case     No.431       of    2009<\/p>\n<p>      subject to the conditions stipulated in<\/p>\n<p>      Section 438(2) of the Code of Criminal<\/p>\n<p>      Procedure.&#8221;\n<\/p>\n<p>                 As a consequence of the present<\/p>\n<p>      modification, the time to surrender by<\/p>\n<p>      petitioner no.4 Mamta Devi is extended<\/p>\n<p>      by a further period of four weeks from<\/p>\n<p>      today.\n<\/p>\n<p>                 Let   this   order    be    communicated<\/p>\n<p>      to   the   court    concerned    by    fax    by    the<\/p>\n<p>      Registry.\n<\/p>\n<\/p>\n<pre>ahk                                 (Jyoti Saran, J)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Satyadeo Prasad &amp;Amp; Ors vs State Of Bihar on 21 December, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
