\nthe judgement and award dated 25.01.2008 passed in
\nMVC No.2 10\/2005 on the file of Civil Judge (Sr..Dn.) &
\nAdditional MACT, Gubbi, partly allowing thehlclaim
\npetition for Compensation and seeking enhan.:ee1nen.t of
\ncompensation.  p   <\/p>\n
This appeal coming on for  da\u00a5,r,d<\/p>\n
the Court, delivered the following:  A <\/p>\n

This appeal is by the”-elaimant’—for’w\u00bben:hVaneenient of<\/p>\n
compensation awarded by the vT4ribu.nal. <\/p>\n
2. Heard.’ _’The   and with the
\neonsent5.ofafppea,ring for the parties, it
\nis taken 5  1l\u00a7inai-   V<\/p>\n
3. For the”sal\ufb01.e’ oi”‘\u00abe:o113.\/enieiice parties are referred to<\/p>\n
 they are\u00bb.1jeferre’d to in the claim petition before the<\/p>\n
2 A  lacts of the case are:\n<\/p>\n
” .,V__d’7i”hat on 1242-04, when the claimant was<\/p>\n
 * –.standing by the side of NH 206 road, in front of Gubbi<\/p>\n
 Channabasaveshwara Theatre, a lorry bearing<\/p>\n
registration No.KA–06–7172 came from Tumkur side in<\/p>\n
%<\/p>\n
a rash and negligent manner and dashed against him.
\nAs a result, the claimant fell down and sustained<\/p>\n
injuries. Hence, he \ufb01led a claim petition b_efore_.’the<\/p>\n
MACT, Bangalore, seeking    I g<\/p>\n

and award has awarded  <\/p>\n
with interest at 6% p.a. Aglgfieved by’   of<\/p>\n
compensation awarded by’*ithen{Tril5t11na1 the Claimant is
\nin appeal seeking enhaneenient ‘oom_p.ensation.\n<\/p>\n
5. As    occurrence of
\naccidentf \u00e9neglipgence of the insurer of the
\noffending’  point that remains for my
\nconsideration   “appeal is:\n<\/p>\n
A  A. W’hethe’r the quantum of
\n_vCo.Inpensation awarded by the Tribunal is<\/p>\n
 .,ju._st Varid proper or does it call for
\nenhangeement?\n<\/p>\n
 pp  hearing the learned Counsel for the parties<\/p>\n
 it perusing the award of the Tribunal, I am of the<\/p>\n
 that the compensation awarded by the Tribunal is<\/p>\n
&<\/p>\n
not just and proper, it is on the lower side and therefore<\/p>\n
it is deserved to be enhanced.\n<\/p>\n
7. As per Wound certificate — Ex.P.5, th4ev..:Cl.aimant<\/p>\n
has sustained the following injuries:<\/p>\n
Fracture of claviclebone ar1ld”‘also  uvry_o’r1 _ <\/p>\n
his head and he had bleeding?froiildnoseliiiandvagear1″<\/p>\n
and injury on upper _eyebrovv’.’-<\/p>\n
Injuries sustained  arealso evident from
\nthe discharge card’; . lcia,sel’sheet — Ex.P.10, x–
\nrays — Exs.   1 an”(i”‘1-lf3’A   slip — Ex.P.12
\nand  evidqencewof the claimant and<\/p>\n
doctors.e\u00a7{:a-‘mined  2 and 3 respectively. He<\/p>\n
was treated from 121204 to 1-1-05 for<\/p>\n
yalaouet 18  in lflistrict Hospital, Tumkur.<\/p>\n
   *  — Dr. B.Rajanr1a, an Orthopaedic Surgeon<\/p>\n
Kllfrorri A  Hospital, Tumkur, has stated in his<\/p>\n
evidence that claimant had fracture of right clavicle<\/p>\n
 bone and also head injuries and he was treated for<\/p>\n
 head injury at NIMHANS Hospital, Bangalore and for<\/p>\n
clavicle injury he was treated at District Hospital,<\/p>\n
%<\/p>\n
Turnkur. He again examined the claimant on 03-05-07
\nand found that clavicle bone was malunited and
\nthereby claimant had suffered 15% physical_4.dlisabi1ity<\/p>\n
for the whole body.\n<\/p>\n
8. Considering the nature of. i_njuri’e’s,’ <\/p>\n
awarded by the Tribunal towai*ds1’paiVn and <\/p>\n
on the lower side and it islldieserved to be and it<\/p>\n
1 award Rs.25,000\/-,. under–t-bais–_he.ad. 0\n<\/p>\n
9. As \u00a7Rs.5,000\/-00′ ‘Tribunal towards<\/p>\n
medical expenses bills produced by<\/p>\n
the    the same is just and<\/p>\n
proper ancl tliaerefore;–i__t”does not call for enhancement.<\/p>\n
10:.’ ‘V Clairnant’Was’ treated as inpatient for 19 days at<\/p>\n
  jldlelospital: Tumkur. He was also treated at<\/p>\n
 ._ NlMFiA1f\\lv$,’AV.V’V:”*’:”]3ElI’lgEllOI’\u20ac. Considering the same.<\/p>\n
 awarded by the Tribunal towards incidental<\/p>\n
* -expenses is on the lower side and it is deserved to be<\/p>\n
 enhanced and I award Rs. 10,000\/- under this head.<\/p>\n

11. Claimant claims to be doing ‘hamali’ work. The
\nTribunal assessing his income at Rs.3,000\/ — permonth<\/p>\n
and considering the period of treatmentf”as’f.three<\/p>\n
months, has rightly awarded Rs.9,000\/~  <\/p>\n
income during laid up period.’  The “sarnel’-is _;’Vus’i; andli’ if<\/p>\n
proper and there is no scope foi’.erihaneement.’. if K<\/p>\n
12. Considering the  doctor
\nand an amount of  land\ufb02unhappiness which
\nhe has to  ‘life, Rs.3,000\/-\n<\/p>\n
awarded   of amenities is on
\nthe   to be enhanced and I
\naward  this head.\n<\/p>\n
13. 5V~V4,~__(l()Q”\/’sdawarded by the Tribunal towards<\/p>\n
 future ‘inr:o’me is as per disability stated by the<\/p>\n
  whole body, there is no scope for<\/p>\n
l ‘ ,er1hancernent under this head.<\/p>\n
