DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/01\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\t\tHeard<br \/>\nthe learned Advocates for the parties.\n<\/p>\n<p>\t\tWhen<br \/>\nthe matter is called out, Mr Tejas Barot, learned Advocate for the<br \/>\napplicants has placed a note with a prayer that mother of applicant<br \/>\nNo.1, -Fuliben Pashabhai Chauhan, resident of Gothaj, Taluka<br \/>\nMehmadabad expired on 20.1.2011 and cremation and other rituals as<br \/>\nper Hindu religion are  likely to take place today in the evening or<br \/>\ntomorrow morning and, therefore, she may be granted temporary bail by<br \/>\nimposing suitable conditions.\n<\/p>\n<p>\t\tLearned<br \/>\nAPP,  however,  is unable to seek instructions about the above<br \/>\naspects.\n<\/p>\n<p>\t\tConsidering<br \/>\nthe facts and circumstances of the case and the note is placed by<br \/>\nlearned Advocate for the applicants stating the facts as above, by<br \/>\nimposing suitable conditions, I am inclined to grant temporary bail<br \/>\nfor a period of three days to accused No.1-Jashiben @ Amratben<br \/>\nGanpatbhai Dabhi on following conditions:\n<\/p>\n<p>\t\tApplicant<br \/>\nNo.1 is in judicial custody  in  District Jail, Nadiad. The Jail<br \/>\nSuperinendent, Nadiad is directed to release  applicant No.1  for<br \/>\nthree days on her furnishing a security  in the sum of Rs. 5000\/-  in<br \/>\ncash and by deputing two women constables\/Head constables for escort<br \/>\nof the applicant No.1, she may be permitted to attend the cremation<br \/>\nceremony of her mother.  Upon completion of three days, the applicant<br \/>\nshall surrender before the  jail authority in time.\n<\/p>\n<p>\t\tThe<br \/>\nApplicant shall deposit the amount of Rs.5,000\/- towards the cost of<br \/>\nthe escort  with the Jail Superintendent,  Direct service today is<br \/>\npermitted.
