PATTANAIK (J)\n\nCITATION:\n 1996 SCC  (4) 522\t  JT 1996 (5)\t434\n 1996 SCALE  (4)485\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     We have heard learned counsel on both sides.<br \/>\n     This appeal by special leave arises from the<br \/>\njudgment and  order dated  March  12,  1993  passed  by\t the<br \/>\nDivision Bench\tof the High Court of Madhya Pradesh, Gwalior<br \/>\nBench in  M.P. No.1484\/91.  The admitted position is that on<br \/>\nAugust\t21,   1991,  the  appellants&#8217;  staff  inspected\t the<br \/>\nelectrical installation\t of the respondents connected by the<br \/>\nappellant-Board. In  the proceedings recorded after the said<br \/>\ninspection, the facts noted are as under:\n<\/p>\n<blockquote><p>     &#8220;During the  course of  inspection,<br \/>\n     Shri  Dilip   was\tpresent\t as  the<br \/>\n     representative of\tM\/s. Harsh  Wood<br \/>\n     Products, Banmore,\t and  found  the<br \/>\n     following\t\t irregularities.<br \/>\n     Connection No.1156 [2556] &#8211;<br \/>\n     1- No  seal found on Meter terminal<br \/>\n     cover.\n<\/p><\/blockquote>\n<blockquote><p>     2- Body seals of the meter, bearing<br \/>\n     No.490812 [Right  side]  and  01443<br \/>\n     [Left Side] found tematampered.<br \/>\n     3- The  seals on Meter Box, bearing<br \/>\n     No.38556\/SE    Morena,    C-10\/MPEB<br \/>\n     Gwalior, found OK.\n<\/p><\/blockquote>\n<blockquote><p>     Connection No.1158 [2824]<br \/>\n     1]\t No   seal  found   with   Meter<br \/>\n     terminal cover.\n<\/p><\/blockquote>\n<blockquote><p>     2]\t Meter\t Body\tseals,\t bearing<br \/>\n     No.49817  [Right\tSide]  &amp;  013361<br \/>\n     [Left  Side]   found   broken   and<br \/>\n     Tampered.<\/p><\/blockquote>\n<blockquote><p>     3]\t Seal\ton  meter   box\t bearing<br \/>\n     No.33434\/SE    Morena     C-10\/MPEB<br \/>\n     Gwalior found OK.\n<\/p><\/blockquote>\n<blockquote><p>\t  In both the above connections,<br \/>\n     the  difference   was  noticed,  in<br \/>\n     serial No.\t and the location of the<br \/>\n     seals provided  on Meter  Body. The<br \/>\n     serial No.\t and the location of the<br \/>\n     meter body\t seals, as  found in the<br \/>\n     inspection\t carried  out  on  dated<br \/>\n     16.3.91, are found different in the<br \/>\n     checking  carried\t out  on   dated<br \/>\n     22.8.91. The  difference noticed in<br \/>\n     serial No.\t &amp; location  in checking<br \/>\n     is as hereunder:-\n<\/p><\/blockquote>\n<pre>\t      Connection       Connection\n\t\t No.2556\t No.2824\n16.3.91\t     Right Side 490817\t  013343\n<\/pre>\n<blockquote><p>Seal fixed   Left Side\t490812\t  013361<br \/>\n28.8.91<br \/>\nReport as    Right Side 490812\t  49817<br \/>\n\t     Left Side\t013343\t  013361<br \/>\nMeter No.\t   0530489\t  545768<br \/>\n\t  This\t panchnama    has   been<br \/>\n     prepared  in  view\t of  Meter  Body<br \/>\n     seals  found   Tempered  and  Meter<br \/>\n     terminal seals  found missing so as<br \/>\n     to interfere and control the energy<br \/>\n     consumption as per his own desire.<br \/>\n\t  Maintaining  &#8220;Status\tQuo&#8221;  of<br \/>\n     the tempered and broken body seals,<br \/>\n     of\t Meter\t of   Both   the   above<br \/>\n     connection, New  Seals are fixed on<br \/>\n     the  meter\t  box  bearing\tNo.M1919<br \/>\n     MPEB\/MT on\t Connection No.2556  and<br \/>\n     NoM  1920\t MPEB\/MT  on  connection<br \/>\n     No.2824. The  old seals provided on<br \/>\n     the meter\tbox are\t in custody with<br \/>\n     the   Executive\tEngineer   [O&amp;M]<br \/>\n     Morena.\n<\/p><\/blockquote>\n<pre>     Sd\/-\tSd\/-\t      Sd\/-\n     22.8.91\t22.8.91\t      22.8.91\n<\/pre>\n<blockquote><p>     EE [O&amp;M]\tS.E [Testing] A.E. [DIW]<br \/>\n     Morena\tGwalior\t      Morena<br \/>\n     Sd\/-\tSd\/-\t      Sd\/-\n<\/p><\/blockquote>\n<pre>     22.8.91\t22.8.91\t      22.8.91\n     A.E.132 KV A.E. [Testing]Dilip\n     S\/s\tMorena\t      [Represen-\n     Banmore\t\t      tative of\n\t\t\t     Consumer]\".\n<\/pre>\n<blockquote><p>     In the  said proceedings, one Mr. Dilip had represented<br \/>\nthe respondent-Industry and he was also the signatory to the<br \/>\nproceedings.  Thereafter,   notice   was   issued   to\t the<br \/>\nrespondents on August 26, 1991 informing that the meter body<br \/>\nseals were tempered and damaged with seal wire. The seals of<br \/>\nthe meter  terminal block  were found  missing\twhich  would<br \/>\nindicate that  the function  of the  meter was\tdisturbed to<br \/>\nreduce the  consumption of electrical energy. Therefore, the<br \/>\nrespondent-Industry was\t directed to  pay the  difference of<br \/>\nthe assessed amount said to be in a sum of Rs.6,51,256.61 at<br \/>\nthe earliest.  It was  also pointed  out that  bill for\t the<br \/>\nfurther past years was being examined and the decision would<br \/>\nbe  taken  and\tintimated  in  due  course.  In\t furtherance<br \/>\nthereof, the  respondent-Industry submitted  the explanation<br \/>\nto the\tshow cause  on August  29, 1991 wherein he requested<br \/>\nthat on\t humanitarian grounds,\tviz ,  &#8220;the  supply  of\t the<br \/>\ninstallation will please be restored immediately and we give<br \/>\nthe undertaking\t that if  any balance amount becomes due for<br \/>\npayment on  account of\tvigilance checking, the same will be<br \/>\ndeposited  immediately\ton  providing  the  bills  for\tsuch<br \/>\namount&#8221;. The  reply was\t also given  by Mr.  Dilip  who\t had<br \/>\nparticipated during inspection.<\/p><\/blockquote>\n<p>     Upon these\t facts, the  question emerges:\twhether\t the<br \/>\nHigh Court  would be justified in interfering with the order<br \/>\ndirecting them to pay the difference of the amount. The High<br \/>\nCourt in  the impugned judgment has held that the respondent<br \/>\nhas a  right of\t hearing before\t the authority subject it to<br \/>\npayment of the amount which is alleged to be due towards the<br \/>\ntheft of electricity as required under Section 31 [e] of the<br \/>\nIndian Electricity Act, 1910. Since that opportunity was not<br \/>\ngiven,\tit   violated  Articles\t  20  [1]   and\t 21  of\t the<br \/>\nConstitution   and,   therefore,   the\t order\t was   void.<br \/>\nAccordingly, it\t directed  the\tappellant-Board\t to  restore<br \/>\nwithin 24  hours the  service connection No.2556\/1156 of the<br \/>\nIndustry. It is also stated with respect to the claim of the<br \/>\nBoard against  electricity stolen  that it  would be open to<br \/>\nthe appellant  to raise\t legal and  appropriate demand\tin a<br \/>\nlegal  and   lawful  manner.  Accordingly,  the\t demand\t was<br \/>\nquashed.\n<\/p>\n<p>     The question,  therefore, is:  whether the\t view of the<br \/>\nHigh Court  is sustainable  in law.  It would  be seen\tthat<br \/>\nSection 49  read with Section 79 of the Electricity (Supply)<br \/>\nAct, 1948  gives power\tto the\tappellant-Board to determine<br \/>\nand also  to revise tariff from time to time. Admittedly, in<br \/>\nexercise of the power the tariff has been determined and the<br \/>\nprinciples governing  the supply  of electricity  have\tbeen<br \/>\nenumerated. Clause  31 [e]  is relevant\t in this  behalf. It<br \/>\nprovides as under:\n<\/p>\n<blockquote><p>\t  &#8220;[e]\tWhere  any  consumer  is<br \/>\n     detected in  the commission  of any<br \/>\n     malpractice with  reference to  his<br \/>\n     use of  electrical energy including<br \/>\n     authorised\t    alternations      to<br \/>\n     installations,\t    unauthorised<br \/>\n     extension and  use\t of  devices  to<br \/>\n     commit theft  of electrical  energy<br \/>\n     the Board may, without prejudice to<br \/>\n     its   other   rights,   cause   the<br \/>\n     consumer&#8217;s supply\tto be  forthwith<br \/>\n     disconnected.  The\t supply\t may  be<br \/>\n     restored in  the discretion  of the<br \/>\n     Division Engineer\tof the\tBoard if<br \/>\n     the consumer  forthwith compensates<br \/>\n     the Board\tand pays all dues as per<br \/>\n     bill and  takes such  other actions<br \/>\n     as\t he   may  be  directed\t by  the<br \/>\n     Divisional Engineer of the Board to<br \/>\n     take in this connection&#8221;.\n<\/p><\/blockquote>\n<blockquote><p>     A reading thereof clearly indicates that the appellant-\n<\/p><\/blockquote>\n<p>Board,<br \/>\nmalpractice with  reference to\this use of electrical energy<br \/>\nincluding   authorised\t  alternations\t to   installations,<br \/>\nunauthorised extension and use of devices to commit theft of<br \/>\nelectrical energy,  may,  without  prejudice  to  its  other<br \/>\nrights, disconnect  the supply\tof electricity forthwith and<br \/>\nmay call  upon the consumer to make payment for compensation<br \/>\nof the\tunauthorised use  of electricity which is now stated<br \/>\nto be  a theft\tof electricity. It is not in dispute that an<br \/>\nFIR had\t already been lodged for theft of electrical energy.<br \/>\nIt is  seen that  the proceedings  have been  drawn  in\t the<br \/>\npresence of  the representative\t of the\t respondent-Industry<br \/>\nand the\t meters were  found to\thave been  tempered with. In<br \/>\nfurtherance thereof,  a prima  facie conclusion of pilferage<br \/>\nhas been  reached that\tthe meters  were tempered  with\t and<br \/>\nrespondents were  called upon  to pay  the difference of the<br \/>\nrate for  electricity said  to have been consumed during the<br \/>\nstated period  of the  detection. It  would appear  that the<br \/>\nsaid assessment\t was based upon the previous consumption. It<br \/>\nis seen that since the proceedings are pending, it would not<br \/>\nbe desirable to record any finding in this behalf.\n<\/p>\n<p>     The learned  counsel for  the respondent  placed strong<br \/>\nreliance on  Section 24\t of the Indian Electricity Act, 1910<br \/>\nwhich contemplates  seven days&#8217; notice before disconnection.<br \/>\nSection\t 24  does  not\tapply  to  demand  on  detection  of<br \/>\npilferage. It  would apply  to a case of regular supply made<br \/>\nand prior  demand for  payment of electricity charges with a<br \/>\nnotice of  seven days  to be  made and\tfor failure  to\t pay<br \/>\nwithin the  given time,\t after expiry  of  seven  days,\t the<br \/>\nappellant as  a licensee  would get  the right to disconnect<br \/>\nthe supply  of electrical energy. It would thus be seen that<br \/>\ndisconnection will  be in  the course  of regular  supply of<br \/>\nelectricity for\t non-payment of\t the usual  bills but not to<br \/>\nany case demand after detection of pilferage.\n<\/p>\n<p>     The only  question is: whether the consumer is entitled<br \/>\nto hearing  before disconnection?  In view of the conditions<br \/>\nto  which   the\t respondents  had  agreed  at  the  time  of<br \/>\ninstallation and  also the prima facie conclusion reached by<br \/>\nthe authorities,  it  was  not\tnecessary  to  give  further<br \/>\nhearing\t to   the  respondents.\t The  action  taken  by\t the<br \/>\nappellant is  not violative  of Articles  20 [1],  14 of the<br \/>\nConstitution and principles of natural justice.\n<\/p>\n<p>     The appeal is accordingly allowed.
