Justice V.K.MOHANAN\n\n Dated :21\/04\/2009\n\n O R D E R\n                        V.K.MOHANAN, J.\n            ----------------------------------------------\n                       B A.No.2062 of 2009\n            ----------------------------------------------\n                     Dated 21st April,    2009.\n\n                               ORDER\n<\/pre>\n<p>      The   petitioner,      who    is   the   accused    in Crime<\/p>\n<p>No.198\/2009 of Pathanapuram Police Station for the offence<\/p>\n<p>punishable under Section         511 and 376 of IPC,          seeks<\/p>\n<p>anticipatory bail.\n<\/p>\n<p>      2.  The allegation against the        petitioner is that  the<\/p>\n<p>petitioner tried to commit rape upon a 7 year old girl child,<\/p>\n<p>named, &#8216;Shiny&#8217;.      It is submitted by the learned counsel for<\/p>\n<p>the petitioner that he is falsely implicated in the above crime<\/p>\n<p>due to the animosity of the de facto complainant towards the<\/p>\n<p>petitioner.\n<\/p>\n<p>      3.  The learned Public Prosecutor stoutly opposed the<\/p>\n<p>prayer.    According to the learned Public Prosecutor, the<\/p>\n<p>petitioner involved in a heinous crime of rape on a minor girl<\/p>\n<p>aged only 7 years old.\n<\/p>\n<p>      4. I have heard the learned counsel for the petitioner as<\/p>\n<p>well as the learned Public Prosecutor.<\/p>\n<p>BA 2062\/09<br \/>\n<span class=\"hidden_text\">                                -:2:-<\/span><\/p>\n<p>      5. The above crime was registered only on 19.3.2009 and<\/p>\n<p>investigation is   only at the     infant stage.   Considering the<\/p>\n<p>seriousness of the allegation, custodial interrogation      of the<\/p>\n<p>petitioner is absolutely necessary.
