DENESAN, J.\n\n\n\n                = = = = = = = = = = = = = = =\n\n                 W.P.(C) No. 10852 OF 2004 P\n\n                = = = = = = = = = = = = = = =\n\n\n\n                Dated this the 19th March, 2007\n\n\n\n                         J U D G M E N T\n<\/pre>\n<p>     The petitioners are Part-time Sweepers attached to<\/p>\n<p>the   Collectorate,   Ernakulam.             Exts.   P9   and   P10<\/p>\n<p>certificates   issued   by   the   P.W.D.   Engineer   show   that<\/p>\n<p>the   sweeping   area   allotted   to   the   1st  petitioner   is<\/p>\n<p>456.58 Sq. ms. and the sweeping area allotted to the 2nd<\/p>\n<p>petitioner   is   402.85   sq.ms.   respectively.              It   is<\/p>\n<p>contended that if the area thus certified is taken into<\/p>\n<p>account,   the   petitioners   are   entitled   to   get   their<\/p>\n<p>services   regularised   as   Part-time   Sweepers   and   to   get<\/p>\n<p>basic pay at the rates sanctioned for sweeping 400 sq.<\/p>\n<p>ms.   to   800   sq.   ms.     The   emoluments   now   paid   to   the<\/p>\n<p>petitioners   is   at   a   consolidated   rate   of   Rs.600\/-   per<\/p>\n<p>mensem and they feel seriously aggrieved.\n<\/p>\n<p>     2.   Government   have   issued   orders   laying   down<\/p>\n<p>guidelines   for   allotting   sweeping   area   for   Part-time<\/p>\n<p>Sweepers   as   also   the   procedure   to   be   followed   for<\/p>\n<p>creation   of   additional   posts   wherever   required.     Govt.\n<\/p>\n<p>Order   dated   25-11-2005   deals   with   the   procedure   for<\/p>\n<p>regularising   the   services   of   Part-time   Sweepers   and<\/p>\n<p><span class=\"hidden_text\">WPC No.10852 \/2004                           -2-<\/span><\/p>\n<p>sanctioning   due   pay   scales   or   emoluments,   as   the   case<\/p>\n<p>may be.  The petitioners have approached the Government<\/p>\n<p>seeking orders based on Govt. Order dated 25-11-2005.\n<\/p>\n<p>     3.         Ext.         P11         representation         filed         by         the<\/p>\n<p>petitioners   is   pending   with   the   2nd  respondent.     Since<\/p>\n<p>the   petitioners   are   working   in   the   Revenue   Department,<\/p>\n<p>Ext.   P11   shall   be   transmitted   to   the   Secretary   to<\/p>\n<p>Government in the Revenue Department.  The request made<\/p>\n<p>by   the   petitioners   for   regularising   their   services<\/p>\n<p>taking   into   account     relevant   aspects   in   the   light   of<\/p>\n<p>Govt.   Order   dated   25-11-2005   deserves   consideration.\n<\/p>\n<p>The   Secretary   to   Government   shall   advert   to   Exts.   P9<\/p>\n<p>and   P10   as   also   orders   relevant   on   the   subject,   take<\/p>\n<p>decision   as  early  as  possible  and  communicate  the  same<\/p>\n<p>to   the   petitioners   within   two   months   from   the   date   of<\/p>\n<p>receipt   of   a   copy   of   the   judgment.                                  Ordered<\/p>\n<p>accordingly.     The   plea   raised   by   the   petitioners   that<\/p>\n<p>the   total   area   as   certified   by   the   P.W.D.   Engineer<\/p>\n<p>comes   to   4675   sq.   ms.   and   the   argument   that   an<\/p>\n<p>equitable   distribution   of   the   total   area     by   proper<\/p>\n<p>apportionment   among   the   8   (eight)   Part-time   Sweepers<\/p>\n<p>including   the  petitioners  now  working  shall  be  made  to<\/p>\n<p><span class=\"hidden_text\">WPC No.10852 \/2004                -3-<\/span><\/p>\n<p>eliminate arbitrariness, shall also be considered.\n<\/p>\n<p>        With   the   above   directions   the   writ   petition   is<\/p>\n<p>disposed of.\n<\/p>\n<p>                                                  K.K.
