Justice C.K.ABDUL REHIM\n\n Dated :20\/01\/2011\n\n O R D E R\n                     C.K.ABDUL REHIM, J\n                ---------------------------------------\n                  W.P(C) No.38696 of 2010-J\n                ----------------------------------------\n         Dated this the 20th day of January, 2011.\n\n                         J U D G M E N T\n<\/pre>\n<p>    Challenge in this writ petition is against coercive steps<\/p>\n<p>of recovery initiated on the basis of Ext.P4 notice.        The<\/p>\n<p>amount was sought to be recovered at the behest of the 4th<\/p>\n<p>respondent, being arrears due under a loan transaction<\/p>\n<p>which was availed by the petitioner and others, for starting<\/p>\n<p>a small scale industrial unit manufacturing aluminium<\/p>\n<p>vessels. It is noticed that the petitioner and others had filed<\/p>\n<p>a civil suit challenging the liability, which ultimately<\/p>\n<p>culminated in a judgment of this Court in R.S.A.No.747 of<\/p>\n<p>2010.   While dismissing the second appeal this Court<\/p>\n<p>observed that the 4th respondent had issued a proceeding<\/p>\n<p>permitting waiver of penal interest on the amount due<\/p>\n<p>under the loan transaction and afforded an opportunity to<\/p>\n<p>the petitioner and others for payment of a sum of<\/p>\n<p>Rs.2,48,821\/- under the &#8216;One Time Settlement Scheme&#8217;.<\/p>\n<p>Ext.P6 is the proceeding issued by the 4th respondent in this<\/p>\n<p><span class=\"hidden_text\">W.P(C) No.38696 of 2010-J     2<\/span><\/p>\n<p>regard. Through Ext.P6, the petitioner was requested to<\/p>\n<p>make payment of the settled amount, on or before<\/p>\n<p>31.12.2010.\n<\/p>\n<p>    2.    Considering the facts and circumstances as stated<\/p>\n<p>above, this Court was not inclined to interfere with the<\/p>\n<p>matter, since no legally tenable ground was seen raised in<\/p>\n<p>order to refute the liability in question.    However, as a<\/p>\n<p>gesture of indulgence, further coercive steps of recovery<\/p>\n<p>was stayed, subject to condition of the petitioner remitting a<\/p>\n<p>sum of Rs.1 lakh. It is reported that the stipulation has<\/p>\n<p>already been complied with. Limited prayer now raised by<\/p>\n<p>counsel for the petitioner is to permit payment of the<\/p>\n<p>amount in terms of Ext.P6.\n<\/p>\n<p>    3.    Learned counsel for the petitioner submits that<\/p>\n<p>the petitioner is ready and willing to pay off the balance<\/p>\n<p>amount covered under Ext.P6, within a short time, in a<\/p>\n<p>phased manner.\n<\/p>\n<p>    4.    Eventhough the writ petition observes no merit on<\/p>\n<p>the basis of the contentions raised, I am of the view that<\/p>\n<p>indulgence can be shown in permitting the petitioner to pay<\/p>\n<p><span class=\"hidden_text\">W.P(C) No.38696 of 2010-J     3<\/span><\/p>\n<p>off the balance amount outstanding in instalments along<\/p>\n<p>with interest, within a reasonable time.\n<\/p>\n<p>     5.   Accordingly, the writ petition is disposed of<\/p>\n<p>directing the respondents to keep in abeyance all further<\/p>\n<p>coercive steps of recovery pursuant to Exts.P4 and P8<\/p>\n<p>notices, provided the petitioner remits the entire balance<\/p>\n<p>amount outstanding under Ext.P6, along with payment of<\/p>\n<p>belated interest if any due, in 3 (three) equal monthly<\/p>\n<p>instalments, falling due on or before 15.2.2011 and on or<\/p>\n<p>before 15th day of two succeeding months.\n<\/p>\n<p>     6.   It is made clear that on the event of default in<\/p>\n<p>payment of any one of the instalments, the respondents will<\/p>\n<p>be free to proceed with further steps on the basis of notices<\/p>\n<p>already issued.
