It is<br \/>\n\tsubmitted that the respondent-accused happened to be mother in law<br \/>\n\tof the deceased and the incident occurred on 10.04.2007 whereby the<br \/>\n\tdeceased committed suicide by setting her to fire. She married the<br \/>\n\tson of the respondent-accused prior to about 3 years from the date<br \/>\n\tof the incident. That it has been established that on account of<br \/>\n\tphysical and mental torture caused by her mother-in-law-accused, the<br \/>\n\tdeceased committed suicide.\n<\/p>\n<p>Learned<br \/>\n\tAdditional Public Prosecutor Ms.C.M.Shah, submitted that it is true<br \/>\n\tthat in her dying declaration recorded by the competent officer, the<br \/>\n\tdeceased stated that she sustained burn injuries by accident.<br \/>\n\tHowever, it has come in evidence that she died on dated 18.04.2007<br \/>\n\tand on that day, she had orally told the complainant who happened to<br \/>\n\tbe her uncle that in fact, there was no accident but because of the<br \/>\n\tpersistent torture and cruelty meted out to her by her mother in<br \/>\n\tlaw, she of her own poured kerosene on her body and ablazed herself.<br \/>\n\tThat, therefore,  the prosecution successfully proved by virtue of<br \/>\n\tthe evidence in the form of oral dying declaration its case beyond<br \/>\n\treasonable doubt. It is submitted that the appeal be admitted.\n<\/p>\n<p>On<br \/>\n\tbare perusal of the impugned judgment and order rendered by the<br \/>\n\tTrial Court, the prosecution case mainly rests upon the evidence of<br \/>\n\tcomplainant Naranbhai Jadavbhai Tank who happened to be uncle of the<br \/>\n\tdeceased. The prosecution also examined Pushpaben Arshibhai Tank as<br \/>\n\twitness who is mother of the deceased. The prosecution examined<br \/>\n\twitnesses viz. Kusumben, Dineshbhai, Laljibhai and Vitthalbhai who<br \/>\n\thappened to be relatives of the deceased. There is no dispute that<br \/>\n\ton 10.04.2007, the deceased sustained burn injuries and she was<br \/>\n\timmediately brought to the hospital by her in-laws and that while<br \/>\n\tshe was under treatment, she succumbed to her burn injuries on<br \/>\n\t18.04.2007. It further transpires that on 10.04.2007 itself, Dy.S.P.<br \/>\n\trecorded the statement of the deceased Exh.25 and there is also no<br \/>\n\tdispute that in the statement Exh-25, deceased stated that she<br \/>\n\taccidentally sustained the burn injuries. It also transpires that<br \/>\n\tfrom 10.04.2007 to 17.04.2007, even the deceased orally told all her<br \/>\n\trelatives that she sustained burn injuries on account of accident.<br \/>\n\tNow, as per the evidence of complainant Naranbhai Jadavbhai Tank who<br \/>\n\twas examined at Exh.13, he deposed that on 18.04.2007 when he went<br \/>\n\tto hospital, Ushaben, the deceased told him that, in fact, she did<br \/>\n\tnot sustain burn injuries in an accident, but, on account of<br \/>\n\tphysical and mental torture and cruelty meted out to her by the<br \/>\n\taccused (her mother-in-law), she poured kerosene on her body and set<br \/>\n\ther to fire.\n<\/p>\n<p>In<br \/>\n\tthe impugned judgment, first of all in Para-9, the Trial Court<br \/>\n\telaborately discussed medical evidence on record and appreciated the<br \/>\n\tevidence of medical officer who conducted P.M. on the body of the<br \/>\n\tdeceased. It is pertinent to note that in his cross-examination<br \/>\n\tregarding the burn injuries, specific question was asked on behalf<br \/>\n\tof the accused as to whether the burn injuries were accidental<br \/>\n\tinjuries or were such, which can be caused at the time of suicide,<br \/>\n\tto which the medical officer specifically replied that looking to<br \/>\n\tthe burn injuries, it was not possible to say as to whether it was<br \/>\n\taccidental burn injuries or suicidal burn injuries.\n<\/p>\n<p>Further<br \/>\n\tmore, in the impugned judgment, the Trial Court at great length<br \/>\n\tdiscussed the oral evidence of the complainant who is uncle of the<br \/>\n\tdeceased, mother of deceased and other relative witnesses and<br \/>\n\tobserved that the oral testimony of the complainant that on<br \/>\n\t18.04.2007, the deceased told him that in fact, she attempted to<br \/>\n\tcommit suicide and the burn injuries were not accidental injuries,<br \/>\n\tcannot be said to have been proved by the prosecution beyond any<br \/>\n\treasonable doubt. The Trial Court observed that the witnesses were<br \/>\n\taware about the previous statement made by the deceased before the<br \/>\n\tcompetent officer and even regarding oral dying declaration earlier<br \/>\n\tmade pertaining to the accidental burn injuries. Yet, on 18.04.2007,<br \/>\n\twhen the deceased made alleged oral dying declaration about the<br \/>\n\tattempted suicide, complainant would have immediately reported about<br \/>\n\tit to the medical officer and to the police, but, nothing whatsoever<br \/>\n\twas done.\n<\/p>\n<p>The<br \/>\n\tTrial Court further observed that according to the evidence of<br \/>\n\tmother and other relative witnesses, on 18.04.2007, the deceased<br \/>\n\tmade the oral dying declaration in their presence but considering<br \/>\n\tthe evidence of the complainant, when the deceased made the oral<br \/>\n\tdying declaration, only he was present. Moreover, it further emerges<br \/>\n\tfrom the evidence on record that the deceased along with her husband<br \/>\n\twas residing separately and the accused was not residing with them.\n<\/p>\n<p>In<br \/>\n\tthe above view of the matter, the Trial Court after appreciating and<br \/>\n\tanalyzing the entire oral and documentary evidence in great detail,<br \/>\n\tultimately, came to the conclusion that the prosecution failed to<br \/>\n\tprove its case beyond any reasonable doubt against the<br \/>\n\trespondent-accused and that she deserved benefits of doubt. We do<br \/>\n\tnot find any infirmity or any error committed by the Trial Court<br \/>\n\twhile appreciating the evidence adduced by the prosecution in this<br \/>\n\tcase and ultimately, coming to the conclusion that the prosecution<br \/>\n\tcase was not proved beyond any reasonable doubt.\n<\/p>\n<p>Under<br \/>\n\tsuch circumstances, no interference by this Court in the impugned<br \/>\n\tjudgment and order is warranted. The application seeking leave to<br \/>\n\tprefer appeal, therefore, deserves to be dismissed.\n<\/p>\n<p>It<br \/>\n\tis well settled that if two views are possible one leading to the<br \/>\n\tinnocence of the accused and another leading to the guilt of the<br \/>\n\taccused, the view leading to the innocence of the accused is<br \/>\n\trequired to be accepted.
