KAPUR DEVI WIFE OF LATE KARU CHAUDHARY, RESIDENT OF\n             MOHALLA MANPUR KUMHAR TOLI, P.S. MUFASIL, DISTRICT- GAYA\n                                Versus\n             1. THE COMMISSIONER-CUM-CHIEF EXECUTIVE OFFICER, MUNICIPAL\n                CORPORATION, GAYA\n             2. THE ACCOUNTS OFFICER, GAYA MUNICIPAL CORPORATION, GAYA\n                             -----------\n<\/pre>\n<p>2   20.09.2010           Heard learned counsels for the petitioner and the<\/p>\n<p>                 respondent-Corporation.\n<\/p>\n<p>                         The grievance of the petitioner is that her husband<\/p>\n<p>                 who was working on the post of Ward Inspector retired on<\/p>\n<p>                 31st July, 2007 and later died on 11th of June, 2010. It is<\/p>\n<p>                 submitted that in the life time of her husband a sum of Rs.<\/p>\n<p>                 1,64,056\/- was paid to the husband of the petitioner<\/p>\n<p>                 without mentioning any details thereof. It is further<\/p>\n<p>                 submitted that after the death of her husband family<\/p>\n<p>                 pension has not been settled as yet with the result the<\/p>\n<p>                 petitioner-widow is facing serious financial crisis.<\/p>\n<p>                         Learned counsel appearing for the respondent-<\/p>\n<p>                 Corporation submits that the claims of the petitioner shall<\/p>\n<p>                 be considered without delay as per law.\n<\/p>\n<p>                         In the above circumstances, learned counsel for<\/p>\n<p>                 the petitioner submits that for expeditious disposal of the<\/p>\n<p>                 pending claims as highlighted in this writ application,<\/p>\n<p>                 petitioner proposes to file a fresh representation before the<\/p>\n<p>                 respondent no.1.\n<\/p>\n<p>                         In view of the above, in case such representation<\/p>\n<p>                 stating details of unpaid claims is filed by the petitioner<br \/>\n            within a period of four weeks from today along with the<\/p>\n<p>           certified copy of the present order as also the copy of the<\/p>\n<p>           relevant documents, if any, in support of the claim, the<\/p>\n<p>           grievances of the petitioner raised in the representation<\/p>\n<p>           shall be considered in accordance with law expeditiously<\/p>\n<p>           preferably within a period of four months on receipt of<\/p>\n<p>           such representation so that the unpaid claims, if any,<\/p>\n<p>           including the family pension may be settled without delay<\/p>\n<p>           and upon consideration the admitted dues found payable<\/p>\n<p>           may also be paid to the petitioner along with interest<\/p>\n<p>           permissible under the rules.\n<\/p>\n<p>                   The writ application stands disposed of with the<\/p>\n<p>           above observations\/directions.\n<\/p>\n<\/p>\n<pre>Manish\/-                          ( Shailesh Kumar Sinha,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Most.Kapur Devi vs The Commissioner-Cum-Chief Exe on 20 September, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.15728 of 2010 MOST.
