The<\/p>\n<p>               reliance placed by the counsel for the State<\/p>\n<p>               on    paragraph       12   of   the    counter       affidavit<\/p>\n<p>               will be of no avail, inasmuch as it only<\/p>\n<p>               talks of appointment of the father of the<\/p>\n<p>               petitioner          without     following         prescribed<\/p>\n<p>               manner but against the sanctioned post. If<\/p>\n<p>               the    post     was    sanctioned        the    respondents<\/p>\n<p>               could not have denied consideration of the<\/p>\n<p>               case of the petitioner for appointment on<\/p>\n<p>               compassionate          ground,        inasmuch        as     the<\/p>\n<p>               circular dated 5.10.1991 does not talk of<\/p>\n<p>               only existence of permanent sanctioned post<\/p>\n<p>               for the deceased employee to be the relevant<\/p>\n<p>               factor    for       considering        the    case    of     his<\/p>\n<p>               dependent      for    appointment       on     compassionate<\/p>\n<p>               ground.\n<\/p>\n<p>                             Counsel for the State in fact has<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>            sought one more indulgence to show that the<\/p>\n<p>            post, on which the father of the petitioner<\/p>\n<p>            was working, consequent to his take-over of<\/p>\n<p>            services     by   the    State     Government,   neither<\/p>\n<p>            against a temporarily sanctioned post nor a<\/p>\n<p>            permanently sanctioned post.<\/p>\n<p>                       This       Court     will   accordingly    give<\/p>\n<p>            one more indulgence to the counsel for the<\/p>\n<p>            State   to    file      his     supplementary    counter<\/p>\n<p>            affidavit on the issue but it is made clear<\/p>\n<p>            that if on next day also there will be no<\/p>\n<p>            supplementary         counter    affidavit   this    Court<\/p>\n<p>            will proceed to decide the matter without<\/p>\n<p>            awaiting for the same.\n<\/p>\n<p>                       List this case on 18th April, 2011<\/p>\n<p>            at the top of the list.\n<\/p>\n<\/p>\n<p>                                              (Mihir Kumar Jha,J.)<\/p>\n<p>Surendra\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
