Justice R.BASANT\n\n Dated :01\/02\/2007\n\n O R D E R\n                                 R.BASANT, J\n\n                              ----------------------\n\n                           W.P.C.No.717 of 2007\n\n                        ----------------------------------------\n\n                Dated this the 1st day of February 2007\n\n\n\n\n                                  JUDGMENT\n<\/pre>\n<p>      The petitioner is the defacto complainant and he had filed a<\/p>\n<p>complaint   before   the   learned   Chief   Judicial   Magistrate<\/p>\n<p>Pathanamthitta   alleging   commission   of   offences   punishable<\/p>\n<p>interalia   under   Sections     420,406   and   468   I.P.C   against   eleven<\/p>\n<p>persons.     The   learned   Chief   Judicial   Magistrate   forwarded   the<\/p>\n<p>complaint   to   the   police   under   Section     156(3)   Cr.P.C.     After<\/p>\n<p>conducting the investigation, a negative final report was filed by<\/p>\n<p>the investigating officer ( a copy of which is produced as Ext.P2).\n<\/p>\n<p>Dissatisfied with the investigation conducted and the final report<\/p>\n<p>filed,   the   petitioner   filed   a   protest   complaint,   Ext.P3.     In   that<\/p>\n<p>complaint,   it   was   prayed   that   a   comprehensive   further<\/p>\n<p>investigation   may   be   directed   to   be   conducted   in   Crime<\/p>\n<p>No.797\/03 registered on the basis of Ext.P1.\n<\/p>\n<p>      2.     The   learned   Magistrate,   by   the   order   dated<\/p>\n<p>28\/08\/2004  (copy of which  is produced as Ext.P4)  directed that<\/p>\n<p>further   investigation   be   conducted.     It   is   the   grievance   of   the<\/p>\n<p>petitioner  that inspite  of the  order  passed by the  learned Chief<\/p>\n<p><span class=\"hidden_text\">W.P.C.No.717\/07                       2<\/span><\/p>\n<p>Judicial   Magistrate,   no   steps   have   been   taken   by   the<\/p>\n<p>investigating   officer   to   conduct   any   further   investigation.\n<\/p>\n<p>Dissatisfied, the petitioner has come before this court for issue of<\/p>\n<p>directions to the investigating officer.   It is alternatively prayed<\/p>\n<p>that in the interests of a proper, efficient and expeditious further<\/p>\n<p>investigation,   the   investigation   may   be   entrusted    to   the   Crime<\/p>\n<p>Branch CID.\n<\/p>\n<p>      3.    Notice   was   given   to   the   learned   Public   Prosecutor.\n<\/p>\n<p>The learned Public Prosecutor, after taking instructions, has got<\/p>\n<p>a   statement   filed   by   the   Circle   Inspector   of   Police,<\/p>\n<p>Pathanamthitta.  It is said to be filed in the office.  A copy of the<\/p>\n<p>same   has   been   made   available   to   the   learned   counsel   for   the<\/p>\n<p>petitioner.  I have perused the same.\n<\/p>\n<p>      4.    In   such   statement,   the   Circle   Inspector   of   Police<\/p>\n<p>asserts  that  he   had  no  information   of  such  an  order  passed  for<\/p>\n<p>further   investigation   under   Section     173(8)   Cr.P.C.     This   writ<\/p>\n<p>petition   was   filed   only   on   05\/01\/2007   and   the   statement   shows<\/p>\n<p>that even earlier, the Circle Inspector of Police was aware of the<\/p>\n<p>direction for further investigation.   He had applied for the copy<\/p>\n<p>of the order Ext.P4 as early as on 02\/09\/2006, it is evident.  Thus<\/p>\n<p><span class=\"hidden_text\">W.P.C.No.717\/07                        3<\/span><\/p>\n<p>long prior to the filing of the petition on 05\/01\/2007, the Circle<\/p>\n<p>Inspector of Police appears to have been aware of Ext.P4 order<\/p>\n<p>passed   by   the   learned   Magistrate.     No   action   has   so   far   been<\/p>\n<p>taken in the matter.\n<\/p>\n<p>5.    I  have  no hesitation  to agree  with  the  learned counsel  for<\/p>\n<p>the   petitioner     that   a   further   investigation   deserves   to   be<\/p>\n<p>conducted   as   directed   in   Ext.P4   order,   as   expeditiously   as<\/p>\n<p>possible.  In the nature of the action taken by the police so far, I<\/p>\n<p>am satisfied that the petitioner is justified in complaining about<\/p>\n<p>the   inadequate   and   improper   steps   taken   by   the   investigating<\/p>\n<p>officer.     The   fourteenth   respondent,   the   Circle   Inspector   of<\/p>\n<p>Police   undertakes   to   conduct   a   proper   investigation.     But   I   am<\/p>\n<p>not satisfied with that undertaking.  Considering the sequence of<\/p>\n<p>events in this case and considering the nature of the contentions<\/p>\n<p>raised   by   the   fourteenth   respondent,     I   am   satisfied   that   this<\/p>\n<p>petition can be allowed and appropriate further directions can be<\/p>\n<p>issued.\n<\/p>\n<p>      6.     This   writ   petition   is   allowed   and   the   following<\/p>\n<p>directions are issued:\n<\/p>\n<p><span class=\"hidden_text\">W.P.C.No.717\/07                        4<\/span><\/p>\n<p>       (i)   The   police   shall   comply   with   Ext.P4   direction   dated<\/p>\n<p>23\/08\/2004   issued   by   the   learned   Chief   Judicial   Magistrate<\/p>\n<p>expeditiously.\n<\/p>\n<p>       ii)     The   thirteenth   respondent   shall   ensure   that   further<\/p>\n<p>investigation   is   conducted   by   a   competent   and   efficient   police<\/p>\n<p>officer not below the rank of a Deputy Superintendent of Police.\n<\/p>\n<p>       Iii)    Necessary  directions in this regard shall  be issued by<\/p>\n<p>the thirteenth respondent within a period of thirty days.   Action<\/p>\n<p>taken shall be reported to the petitioner and to this court.\n<\/p>\n<p>       6.
