JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/05\/2011  \nORAL ORDER<\/pre>\n<p>1.\tThis<br \/>\napplication has been filed with prayers to delete respondent No.4<br \/>\nfrom the era of respondents as well as to delete prayer at<br \/>\nparagraph-9(B) in Special Civil Application No.6663\/2001.\n<\/p>\n<p>2.\tHeard<br \/>\nMr.Samir B. Gohil, learned advocate for Mr.I.S.Supehia, learned<br \/>\ncounsel for the applicant (original petitioner) and perused the<br \/>\naverments made in the application. It is submitted by the learned<br \/>\ncounsel for the applicant that the whereabouts of respondent No.4 are<br \/>\nnot known at present and the prayer made at paragraph-9(B) of the<br \/>\nabove-mentioned petition, which is directed against the said<br \/>\nrespondent is also required to be deleted along with the name of<br \/>\nrespondent No.4, as his presence in the petition is not necessary for<br \/>\nits adjudication.\n<\/p>\n<p>3.\tHaving<br \/>\nheard the learned counsel for the applicant and in view of the<br \/>\naverments made in the application, the prayers made therein deserve<br \/>\nto be granted.\n<\/p>\n<p>4.\tAccordingly,<br \/>\nthe application is allowed. The applicant (original petitioner) is<br \/>\npermitted to delete respondent No.4 from the era of respondents in<br \/>\nSpecial Civil Application No.6663\/2001.<br \/>\nIn addition, the applicant is permitted to delete prayer at<br \/>\nparagraph-9(B) made in the above-mentioned petition.
