The matter came up for<br \/>\nhearing on 21.09.2011 through videoconferencing. The appellant was absent, whereas the<br \/>\nrespondents were represented by Shri U. Panda, CPIO at NIC Videoconferencing Facility<br \/>\nCentre, Burdwan.\n<\/p>\n<p>2.      The appellant filed an RTI-application dated 15.3.2007 seeking &#8220;zerox copy of his<br \/>\napplication form for obtaining CMPF account number No. DKR-127, which was given after<br \/>\nhis date of appointment i.e. 29.11.1972 and zerox copy of the provision of Para 48 of<br \/>\nCMPF Scheme duly certified&#8221;. The CPIO vide letters No. CPF\/MISC\/RTI\/BKR\/27\/R-<br \/>\nIII\/ASN\/27 dated 5.4.2007 followed by letter No. 133 dated 26.4.2007 provided requisite<br \/>\ninformation to the appellant.\n<\/p>\n<p>3.      Aggrieved by the reply of CPIO, the appellant preferred first-appeal dated<br \/>\n9.7.2007before FAA. The FAA vide order No. CPF\/Div:II\/RTI\/R-III\/Asansol\/1014 NAGPUR<br \/>\ndated 27.12.2007 provided to the appellant copy of relevant page of Allotment Register<br \/>\nwhich is a replica of the &#8216;H&#8217; return.\n<\/p>\n<p><span class=\"hidden_text\">                                              2      Case No. CIC\/AT\/A\/2010\/001114\/SS<\/span><\/p>\n<p>4.     During the hearing the respondent submitted that the instant appeal of the<br \/>\nappellant primarily points towards a dispute in his date of birth in his Form-B register<br \/>\nmaintained by his employer i.e. the management of Chinakuri Mine-II under ECL. In the<br \/>\ninstant appeal the appellant has expressed his doubt regarding manipulation in his date of<br \/>\nbirth in &#8216;Form-B&#8217; register, which is a document maintained by the employer and not by the<br \/>\nCMPFO. The CMPFO is not the custodian of his employment record. The appellant&#8217;s PF<br \/>\nmoney amounting to Rs. 738051\/-, has already been refunded to him on 31.1.2011 on his<br \/>\nclaim after exit from service. In addition, &#8216;Form-H&#8217; does not contain any information<br \/>\nregarding date of birth of a subscriber. Moreover, the appellant&#8217;s identical complaint was<br \/>\nheard by the Commission in case No. CIC\/AT\/C\/2007\/01279 and the Commission vide its<br \/>\norder dated 18.2.2008 had observed that &#8220;since all information has now been disclosed to<br \/>\nthe appellant, this matter need not be further progressed&#8221;.\n<\/p>\n<p>5.     After hearing the submissions of respondent and perusing the relevant documents<br \/>\nin file, the Commission is of the considered view that requisite information permissible<br \/>\nunder the RTI Act, has been provided to the appellant by the respondent.
