      This petition is for anticipatory bail.\n<\/p>\n
      2. The alleged offence is under section 436 IPC. According to<\/p>\n
prosecution, petitioners set fire to a thatched shed on 19.5.2010 at<\/p>\n
1.45 am and thereby causing damage to the tune of Rs.20,000\/-.<\/p>\n
      3. According to learned counsel for petitioners, there is a civil<\/p>\n
dispute between the parties in respect of a way leading to the house<\/p>\n
of the defacto complainant through petitioner’s property. An interim<\/p>\n
injunction order is obtained by 1st petitioner, as per annexure-1 order<\/p>\n
against defacto complainant and others.                  Thereafter defacto<\/p>\n
complainant, with the support of political party (C.P.I.M), started<\/p>\n
harassing the petitioner and the workers of the first accused were<\/p>\n
assaulted and a complaint was made to the police and case was<\/p>\n
registered u\/s.324, 294(b) and 34 IPC.\n<\/p>\n
      4.    Since the defacto complainant continued such illegal<\/p>\n
activities, first accused applied for police protection before the Sub<\/p>\n

Inspector of Police (annexure -III). There was also an attempt to<\/p>\n
destroy a compound wall and defacto complainant intimidated<\/p>\n
stating that first accused’s arms will be cut off etc. After filing<\/p>\n
annexure -III, posters appeared indicating threat against first<\/p>\n
accused from CPI(M). Thereafter, a complaint was lodged stating<\/p>\n
that a thatched shed was set fired to by petitioners. Actually,<\/p>\n
defacto complainant and his people set fire to the thatched shed<\/p>\n
by themselves, but a false complaint is filed against petitioners to<\/p>\n
harass them. If they are arrested, they will suffer irreparable<\/p>\n
injury and loss especially since defacto complainant is supported<\/p>\n
by ruling party. It is pointed out that name of the petitioner does<\/p>\n
not find a place in the FI statement.\n<\/p>\n
       5.    This petition is strongly opposed.          Learned public<\/p>\n
prosecutor submitted that petitioners’ involvement is revealed<\/p>\n
from the statement given by various witnesses in the case diary.<\/p>\n
An autorikshaw driver had seen petitioner leaving the place in a<\/p>\n
car, after committing the offence on 19.5.2010 at about 1.45am.<\/p>\n
The crime is being investigated into and if petitioners are granted<\/p>\n
bail, it will adversely affect the investigation, it is submitted.<\/p>\n
       6. On hearing both sides, it appears that there is a civil<\/p>\n
dispute between the parties and petitioners had obtained orders<\/p>\n

from the civil court against defacto complainant and others. It is<\/p>\n
also    seen    that    petitioners  and   family    members     were<\/p>\n
apprehending danger to the lives and property and they had even<\/p>\n
applied for protection as per annexure-III. Even thereafter, the<\/p>\n
posters appeared which would indicate threat again from workers<\/p>\n
of CPI(M). The parties are residing adjacent compounds, but as<\/p>\n
per the statement of autorikshaw driver, petitioners were found<\/p>\n
escaping in a car. In the above circumstances, I am satisfied that<\/p>\n
if anticipatory bail is not granted to petitioners, it will result in<\/p>\n
injustice. Hence the following order is passed:<\/p>\n
         1) Petitioners shall surrender before the investigating<\/p>\n
           officer within seven days from today and co-operate<\/p>\n
           with the investigation.\n<\/p><\/blockquote>\n
<\/blockquote>\n
         2) In the event of their arrest, petitioners shall be<\/p>\n
           produced before the Magistrate court concerned, in<\/p>\n
           accordance with law, and they shall be released on<\/p>\n
           bail on their executing bond for Rs.50,000\/- each<\/p>\n
           with two solvent securities for the like amount to<\/p>\n
           the satisfaction of the learned Magistrate on the<\/p>\n
           following conditions:\n<\/p><\/blockquote>\n
<\/blockquote>\n
              i) Petitioners shall report before the investigating
\n                 officer as and when directed and co-operate
\n                 with investigation.\n<\/p><\/blockquote>\n

              ii) Petitioners shall not influence or intimidate any
\n                  witnesses or tamper with evidence.<\/p>\n<\/blockquote>\n
             iii) Petitioners shall not enter the limits of the

\n                  for a period of two months from today.<\/p>\n
      This petition is allowed.\n<\/p><\/blockquote>\n
