Respondent\n\n\nPrayer\n\n\nWrit Petition filed under Article 226 of the Constitution of India\npraying this Court to issue a Writ of Mandamus directing the respondent herein\nto register the supplementary Trust Deed executed by the petitioner and issue\nthe same without demanding advalorem stamp duty  on the value of the property of\nthe Trust contrary to the stamp duty fixed under Schedule I item 64 of the\nIndian Stamp Act.\n\n\n!For Petitioner\t\t...\tMr.La Law\n\n\n^For Respondent \t...\tMr.So.Paramasivam,\n\t\t\t\tGovernment Advocate (CS)\n\n\n:ORDER\n<\/pre>\n<p>\tThis Writ Petition has been focussed to direct the respondent herein to<br \/>\nregister the supplementary Trust Deed executed by the petitioner and release the<br \/>\nsame without demanding advalorem stamp duty  on the value of the property of the<br \/>\nTrust.\n<\/p>\n<p>\t2.Heard both sides.\n<\/p>\n<p>\t3.The facts in nutshell which are absolutely necessary and germane for the<br \/>\ndisposal of this Writ Petition would run thus:<br \/>\n\tWhen the Supplementary Trust Deed of the Sri Pushpam College Trust was<br \/>\npresented to the respondent for registration, the respondent demanded payment of<br \/>\nadvalorem stamp duty on the Trust Deed. Thereupon being aggrieved by it this<br \/>\nwrit petition has been filed.\n<\/p>\n<p>\t4.Per contra, the gist and kernel of the counter filed by the respondent<br \/>\nwould be to the effect that no supplementary Trust Deed was produced at all and<br \/>\nin such a case the question of the respondent demanding advalorem Court fee does<br \/>\nnot arise.\n<\/p>\n<p>\t5.Taking into consideration the stand of the respondent, this writ<br \/>\npetition could be disposed of without probing into the details as to whether he<br \/>\nactually demanded advalorem Court fee or not and what should be  the stamp duty<br \/>\non the Supplementary Trust Deed etc. Here the stand of the respondent is that<br \/>\nsupplementary Trust Deed has not been produced and in such a case once again the<br \/>\npetitioner could  produce the deed as per law.  On behalf of the petitioner<br \/>\nalso, the  learned counsel for the petitioner would submit that even  now the<br \/>\npetitioner is ready to present the supplementary Trust Deed to the respondent<br \/>\nfor registration and there upon let the respondent be directed to act as per<br \/>\nlaw.\n<\/p>\n<p>\t6.Hence in the facts and circumstances of the case, the following<br \/>\ndirections is issued.\n<\/p>\n<p>\tWithin a period of one week the petitioner shall present the supplementary<br \/>\nTrust Deed before the respondent, thereupon within a week  there from he shall<br \/>\ndeal with it as per law.\n<\/p>\n<p>\t7.Accordingly, the writ petition is disposed of. No costs.
