The Company Secretariat, Bihar State Seeds Corporation Limited, Patna\n\n\n07\/   06.07.2010<\/pre>\n<p>             In response to the observations of this Court made under<\/p>\n<p>                   orders dated 13.10.2009, counsel for the Bihar Seeds Corporation Ltd.<\/p>\n<p>                   has filed supplementary counter affidavit on behalf of Respondents 2<\/p>\n<p>                   and 4 to the first and second supplementary affidavit filed on behalf of<\/p>\n<p>                   petitioner and with reference to the averments made in the said<\/p>\n<p>                   supplementary counter affidavit, it is submitted by the counsel for the<\/p>\n<p>                   Seeds Corporation that the deputationists serving in the Corporation<\/p>\n<p>                   are also paid the salary and emoluments in the light of the<\/p>\n<p>                   recommendations of the 4th Pay Revision Recommendations and not<\/p>\n<p>                   in the light of the 5th\/ 6th Pay Revision Recommendations as is being<br \/>\n<span class=\"hidden_text\">                                -2-<\/span><\/p>\n<p>         done in the case of the employees of the Corporation. Counsel,<\/p>\n<p>         however, submitted that in the Corporation deputationists, 35 in<\/p>\n<p>         number, are still serving and as the superannuation age of the<\/p>\n<p>         employees of the Corporation to which deputationists belong has<\/p>\n<p>         already been extended to 60 years, the deputationists shall be allowed<\/p>\n<p>         to serve the Corporation until they attain the age of 60 years<\/p>\n<p>         notwithstanding the fact that till date the Seeds Corporation has not<\/p>\n<p>         taken any decision to extend the age of superannuation of its<\/p>\n<p>         employees to 60 years.\n<\/p>\n<p>                   2. The action of the Seeds Corporation not to extend the age<\/p>\n<p>         of superannuation of its employees to 60 years and to allow the benefit<\/p>\n<p>         of the extended retirement age to the deputationists on the ground that<\/p>\n<p>         the age of superannuation of the employees of the other<\/p>\n<p>         Corporation(s) to which the deputationists belong has been extended,<\/p>\n<p>         tantamounts to creating a separate class amongst the employees<\/p>\n<p>         without there being any tangible differentia to differentiate them from<\/p>\n<p>         the other employees of the Seeds Corporation appears to be arbitrary<\/p>\n<p>         violating the provisions contained in Article 14 of the Constitution of<\/p>\n<p>         India.\n<\/p>\n<p>                   3. Accordingly, it is directed that the deputationists serving<\/p>\n<p>         the Seeds Corporation should also not be allowed to continue in the<\/p>\n<p>         Seeds Corporation beyond 58 years.\n<\/p>\n<p>                   4.
