MUKHOPADHAYA)<\/p>\n<p>\tThe<br \/>\nappeal was listed for removal of defect of certified copy of the<br \/>\norder passed by the learned Single Judge having not enclosed.<br \/>\nLearned counsel for the appellant would contend that he has already<br \/>\nenclosed typed copy of the said order, but he prays to withdraw the<br \/>\nappeal to enable the appellant to move before the State authorities,<br \/>\nin view of the Government Resolution of 1990 at page No. 62-A.  Ms.<br \/>\nlearned AGP appearing for the State has no objection to the same.\n<\/p>\n<p>\tIn<br \/>\nthe circumstances, we allow the appellant to withdraw the appeal to<br \/>\nenable the appellant to move without any liberty to file fresh appeal<br \/>\nagainst the very same order.
