And Others\nPetitioner Counsel :- Raj Karan Yadav\nRespondent Counsel :- C.S.C.\n\nHon'ble Prakash Chandra Verma,J.\n<\/pre>\n<p>Hon&#8217;ble Ram Autar Singh,J.\n<\/p>\n<p>By means of this petition the petitioner has prayed for writ of mandamus<br \/>\ncommanding the respondents not to disturb the petitioners possession over the<br \/>\nproperty in dispute.\n<\/p>\n<p>We have heard learned counsel for the parties and have gone through the<br \/>\nrecord.\n<\/p>\n<p>The Urban Land (Ceiling and Regulation) Act, 1976 was repealed by The<br \/>\nUrban Land (Ceiling And Regulation) Repeal Act, 1999 (15 of 1999), (herein<br \/>\nafter referred to as an Act). Section 3 of the Act reads as under:-\n<\/p>\n<p>&#8220;3. Saving.- (1) The repeal of the principal Act shall not affect-\n<\/p>\n<p>(a) the vesting of any vacant land under sub-section (3) of Section 10,<br \/>\npossession of which has been taken over the State Government or any person<br \/>\nduly authorised by the State Government in this behalf or by the competent<br \/>\nauthority;\n<\/p>\n<p>(b) the validity of any order granting exemption under sub-section (1) of<br \/>\nSection 20 or any action taken thereunder, notwithstanding any judgement of<br \/>\nany court to the contrary;\n<\/p>\n<p>(c) any payment made to the State Government as a condition for granting<br \/>\nexemption under sub-section (1) of Section 20.\n<\/p>\n<p>(2) Where.-\n<\/p>\n<p>(a) any land is deemed to have vested in the State Government under sub-<br \/>\nsection (3) of Section 10 of the principal Act but possession of which has not<br \/>\nbeen taken over by the State Government or any person duly authorised by the<br \/>\nState Government in this behalf or by the competent authority; and<\/p>\n<p>(b) any amount has been paid by the State Government with respect to such<br \/>\nland then, such land shall not be restored unless the amount paid, if any, has<br \/>\nbeen refunded to the State Government.\n<\/p>\n<p> A perusal of Clause (a) of sub-section 2 of Section 3 clearly provides where<br \/>\nthe possession of the land has not been taken over the said land shall not vest<br \/>\nin the State despite the proceedings having drawn. Here the possession will<br \/>\nmean the actual physical possession. The categorical statement has been made<br \/>\nin the writ petition that the possession has not been taken over by the State till<br \/>\ndate and petitioner is in possession.\n<\/p>\n<p>In the writ petition counter has been filed in which this fact has not been<br \/>\ndenied rather it has been stated that possession has been taken over but it has<br \/>\nnot been substantiated by evidence whether actual physical possession has<br \/>\nbeen taken over or not. There is no receipt obtained by the Collector<br \/>\nconcerned from the owner of the land handing over the possession.\n<\/p>\n<p>In the case of State of Tamil Nadu and another v. Mahalakshmi Ammal<br \/>\nand others reported in (1996) 7 SCC 269 has categorically held that<br \/>\n&#8220;possession of the acquired land would be taken only by way of<br \/>\nmemorandum, panchnama, which is a legally accepted norm.&#8221; There is no<br \/>\nsuch document with counter affidavit filed by State of U.P. on record.\n<\/p>\n<p>Possession on paper is a symbolic possession and word &#8216;possession&#8217; used in<br \/>\nClause (a) of Section (2) of Section 3 of the Act mean actual physical<br \/>\npossession and not the symbolic possession.\n<\/p>\n<p>After the repealing of the Urban Land (Ceiling and Regulation) Act 1976 by<br \/>\nAct No. 15 of 1999 Urban Land (Ceiling and Regulation Repeal) Act 1999<br \/>\nthe petitioners are entitled to the benefit of Section 3 of the Act No. 15 of<br \/>\n1999. The petitioners land shall not be treated to have been declared as vacant<br \/>\nland under the repeal Act.\n<\/p>\n<p>For the reasons recorded above the instant writ petition is allowed.
