S.J.MUKHOPADHAYA)<\/p>\n<p>\tThe<br \/>\nCentral Sales Tax Appellate Authority, New Delhi (for short, &#8216;the<br \/>\nAppellate Authority&#8217;), by order dated 6th August 2010,<br \/>\ndecided the appeal preferred by the petitioner under Section 20 of<br \/>\nthe Central Sales Tax Act, 1956 (for short, &#8216;the Act&#8217;). The said<br \/>\nappeal was preferred against the order passed by the Value Added Tax<br \/>\nTribunal, Ahmedabad.\n<\/p>\n<p>\tThe<br \/>\nAppellate Authority, referring Section 6A of the Act and the other<br \/>\nprovisions, the facts of the case and the decision of the Supreme<br \/>\nCourt, by its order dated 6th August 2010, upheld the<br \/>\nimposition of tax.\n<\/p>\n<p>\tIt<br \/>\nappears that at this stage, the petitioner moved before the Supreme<br \/>\nCourt in Special Leave to Appeal (Civil) No.35734\/2010. The said<br \/>\npetition was withdrawn on 11th February 2011 with a<br \/>\nliberty to move before the High Court under Article 226 of the<br \/>\nConstitution of India. The Supreme Court directed that if the<br \/>\npetitioner files a writ petition, the High Court may consider the<br \/>\nsame on its own merits.\n<\/p>\n<p>\tThe<br \/>\npresent writ petition has been preferred with a prayer to allow the<br \/>\nfirst petitioner to produce evidence before the Central Sales Tax<br \/>\nAuthorities to establish that the goods were despatched on<br \/>\nconsignment basis and not by way of interstate sale. In the<br \/>\nalternative, validity of Section 6A of the Act is also challenged.\n<\/p>\n<p>\tAfter<br \/>\narguments on the question of validity of Section 6A of the Act and as<br \/>\nthe Court was, prima facie, not inclined to accept such submission,<br \/>\nlearned counsel appearing on behalf of the petitioner submitted that<br \/>\nthe petitioner will not desire to challenge the validity of Section<br \/>\n6A of the Act.
