CHINNAPPA (J)\n\nCITATION:\n 1981 SCR  (1) 373\n\n\nACT:\n     Cycle-Rickshaw Bye-Law 1960-Bye-Law 3(1) Cycle Rickshaw\nDrivers-Court Framing Scheme.\n\n\n\nHEADNOTE:\n     The Delhi\tMunicipal Corporation Which framed the Cycle\nRickshaw Bye  Law of  1960 under  section 481  of the  Delhi\nMunicipal Corporation Act, 1957 amended Bye-law 3 in 1976 to\nprovide that  'no person  shall keep or ply for hire a cycle\nrickshaw in Delhi unless he himself is the owner thereof and\nholds a licence granted in that behalf'.\n     In writ petitions challenging the provision:\n^\n     HELD:\n     In Azad  Rickshaw Pullers\tUnion Amritsar\t&amp; others  v.\nState of Punjab &amp; others, [1981] I SCR 366 a scheme had been\nworked\tout   to  help\t the  rickshaw\tpliers\tof  Amritsar\nMunicipality to become owners of cycle rickshaws. [374 A-B]\n     2. The  Delhi Administration will effectively publicize\nand notify  applications for  licences for  plying of  cycle\nrickshaws and  all those  who apply  will be  considered  on\ntheir merits  including length\tof service as cycle rickshaw\npliers. The  criteria that  the\t Delhi\tAdministration\twill\nadopt must be reasonable and relevant. [374 D]\n     3. On  the\t basis\tof  reasonable\tcriteria  the  Delhi\nAdministration\t will\tdirect\t the   concerned   Municipal\nauthorities to\tgrant licences\tfor plying rickshaws and the\napplicants so  chosen are  not\towners\tthemselves  all\t the\nfacilities indicated  in the Amritsar order will be extended\nto such cycle rickshaw pliers fixing reasonable time limits.\n[374F]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>     ORIGINAL  JURISDICTION:  Writ  Petition  Nos.  841\t and<br \/>\n728\/1980.\n<\/p>\n<p>\t\t    (Under Article 32 of the Constitution.)<br \/>\n     R. Maheshwari and Suresh<br \/>\nSeth for the RR in WP Nos. 841 and 728.\n<\/p>\n<p>     The Judgment of the Court was delivered by<br \/>\n     KRISHNA IYER, J.-We have disposed of today applications<br \/>\nfrom cycle  rickshaw pliers of Amritsar Municipality where a<br \/>\nscheme has  been worked\t out to\t help them  become owners of<br \/>\ncycle rickshaws. A<br \/>\n<span class=\"hidden_text\">374<\/span><br \/>\nsimilar scheme, says the Solicitor-General appearing for the<br \/>\nDelhi  Administration,\t will  be   extended  to  the  Delhi<br \/>\nterritory. We,\ttherefore, annex  a copy  of the judgment in<br \/>\nWrit Petitions\tNos.  839  of  1979  and  563  of  1979-<a href=\"\/doc\/246766\/\">Azad<br \/>\nRickshaw Pullers  Union, Amritsar  and others  v.  State  of<br \/>\nPunjab &amp;  others and  Nanak Chand  and others<\/a>  v.  State  of<br \/>\nPunjab and others, respectively to this judgment.\n<\/p>\n<p>     There is  another problem\twhich arises  in  these\t two<br \/>\ncases and  that is  that the  Delhi Administration has put a<br \/>\nceiling on  the total  number of cycle rickshaws permissible<br \/>\nto be  plied within its territory perhaps-we do not know for<br \/>\ncertain-this number  may not  accommodate all the applicants<br \/>\nfor cycle  rickshaws applying  licencees. We  are told\tthat<br \/>\napart from  the applicants in this Court under Article 32 of<br \/>\nthe Constitution,  there are  numerous petitioners  who have<br \/>\napproached the\tHigh Court of Delhi under Article 226 of the<br \/>\nConstitution and  yet others  who have\tfiled suits in civil<br \/>\ncourts for  the same relief. All that we can do is to accept<br \/>\nthe suggestion\tmade by\t the learned  Solicitor-General that<br \/>\nthe Delhi  Administration  will\t effectively  publicize\t and<br \/>\nnotify\tapplications  for  licencees  for  plying  of  cycle<br \/>\nrickshaws and  all those  who apply  will be  considered  on<br \/>\ntheir merits  including length\tof service as cycle rickshaw<br \/>\npliers. The  criteria that  the\t Delhi\tAdministration\twill<br \/>\nadopt must  be reasonable and relevant; otherwise it will be<br \/>\nopen to\t the aggrieved\tparties to  challenge the selection.<br \/>\nLikewise we  do not  want to  fetter the  rights of  parties<br \/>\naggrieved if  the ceiling upon the total number of rickshaws<br \/>\npermissible within the Delhi territory is arbitrary.\n<\/p>\n<p>     On\t the   basis  of   reasonable  criteria\t  the  Delhi<br \/>\nAdministration\t will\tdirect\t the   concerned   Municipal<br \/>\nauthorities to\tgrant licences\tfor plying  rickshaws and if<br \/>\nthe applicants\tso chosen  are not owners themselves all the<br \/>\nfacilities we  have indicated  in the Amritsar order will be<br \/>\nextended to  such cycle\t rickshaw pliers  fixing  reasonable<br \/>\ntime  limits.  With  these  directions\twe  dispose  of\t the<br \/>\napplications.
