Justice K.T.SANKARAN\n\n Dated :26\/11\/2010\n\n O R D E R\n                    K.T.SANKARAN, J.\n          ------------------------------\n             W.P.(C).No.35287     OF 2010\n          ------------------------------\n     Dated this the 26th day of November, 2010\n\n\n\n\n                       JUDGMENT\n<\/pre>\n<p>    The petitioner is working as L.P.S.A. in the<\/p>\n<p>Aided Lower Primary School, Chuvannamannu, Thrissur<\/p>\n<p>District.  As per Ext.P7 staff fixation order for<\/p>\n<p>2010-2011,  the  petitioner    was   held   to   be  not<\/p>\n<p>entitled to protection and she was retrenched from<\/p>\n<p>service with effect from 15.7.2010. As per the<\/p>\n<p>staff   fixation     order,    the     6th   respondent<\/p>\n<p>C.P.Minikumary, P.K.Suja and Jeicy Varghese were<\/p>\n<p>held  eligible   for    protection    as   per    G.O(P)<\/p>\n<p>No.175\/99\/G.Edn. dtd.26.7.1999.        Thereafter, the<\/p>\n<p>Assistant Educational Officer passed Ext.P8 order<\/p>\n<p>dated 4.11.2010, the operative portion of which<\/p>\n<p>reads as follows:\n<\/p>\n<\/p>\n<blockquote><p>             &#8220;In the above circumstances taking into<br \/>\n        account the 1:40 teacher student ratio in<br \/>\n        terms of G.O(P)191\/10\/G.Edn. dated 22.9.2010<br \/>\n        Smt.C.P.Minikumary the senior most protected<br \/>\n        LPSA who is rendered surplus during the year<br \/>\n        2010-11 allowed to retain in the school for<br \/>\n        2010-2011 as per Endorsement letter No.B1-\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\">W.P.(C).No.35287 OF 2010     2<\/span><\/p>\n<blockquote><p>          17215\/10 dtd.18.10.2010 of Deputy Director of<br \/>\n          Education, Thrissur.\n<\/p><\/blockquote>\n<blockquote><p>                The staff fixation order read (1) above<br \/>\n          stands modified to this extend.&#8221;<\/p><\/blockquote>\n<p>    2.    The   learned    counsel    for    the  petitioner<\/p>\n<p>submitted    that   Ext.P8    order   was    issued  by  the<\/p>\n<p>Assistant Educational Officer, on the basis of G.O(P)<\/p>\n<p>191\/10\/G.Edn. Dated 22.9.2010.\n<\/p>\n<\/p>\n<p>    3. In this Writ Petition, the petitioner has<\/p>\n<p>prayed for the following reliefs:\n<\/p>\n<\/p>\n<blockquote><p>     &#8220;(i) To issue a Writ of certiorari or any other<br \/>\n         appropriate writ, order or direction, calling<br \/>\n         for the records leading to Ext.P8 and quash the<br \/>\n         same to the extent it directs retrenchment of<br \/>\n         the petitioner and further it allows the 6th<br \/>\n         respondent   to   continue   in   the  A.L.P.S.,<br \/>\n         Chuvannamannu;\n<\/p><\/blockquote>\n<blockquote><p>     (ii) To   declare    that   the   petitioner who is<br \/>\n         entitled for protection under Exts.P10 and P11<br \/>\n         orders is eligible to continue in A.L.P.S.,<br \/>\n         Chuvannamannu and the 6th respondent is claiming<br \/>\n         the benefit of protection under Exts.P12 to P16<br \/>\n         orders is liable to be deployed to a government<br \/>\n         school;\n<\/p><\/blockquote>\n<blockquote><p>     (iii) To   issue  a  Writ  of  Mandamus or any other<br \/>\n         appropriate writ, order or direction, directing<br \/>\n         the respondents 1 to 5 to allow the petitioner<br \/>\n         to continue as L.P.S.A in A.L.P.S, Chuvannamannu<br \/>\n         in preference to the 6th respondent.\n<\/p><\/blockquote>\n<blockquote><p>     (iv) To issue    an   injunction   restraining  the<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No.35287 OF 2010     3<\/span><\/p>\n<p>         respondents  4   &amp;   5  from  retrenching  the<br \/>\n         petitioner from A.L.P.S., Chuvannamannu on the<br \/>\n         basis of Ext.P8 order: And<\/p>\n<\/blockquote>\n<blockquote><p>     (v) To grant such other and further reliefs as are<br \/>\n         just, proper and necessary in the facts and<br \/>\n         circumstances of the case.&#8221;<\/p><\/blockquote>\n<p>    4. As against Ext.P8 order, the petitioner has an<\/p>\n<p>alternative remedy of filing a revision before the<\/p>\n<p>Director of Public Instruction under Rule 12E(3) of<\/p>\n<p>Chapter   XXIII   KER.  Against    Ext.P7  staff   fixation<\/p>\n<p>order, the petitioner has a right to file a revision<\/p>\n<p>before the Director of Public Instruction. Therefore,<\/p>\n<p>the petitioner having effective alternative remedy, I<\/p>\n<p>am of the view         the Writ Petition need not be<\/p>\n<p>entertained. The other reliefs prayed for in the Writ<\/p>\n<p>Petition would become unnecessary if the revision<\/p>\n<p>filed by the petitioner is decided in his favour.       The<\/p>\n<p>learned counsel for the petitioner submitted that the<\/p>\n<p>Assistant Educational Officer passed Ext.P8 order, on<\/p>\n<p>the   basis   of   GO(Rt)   No.4011\/2010\/G.Edn.       dated<\/p>\n<p>15.9.2010 (Ext.P9) and therefore, the petitioner has<\/p>\n<p>filed this Writ Petition. It is submitted that if the<\/p>\n<p>alternative     remedy    is    availed,   still,    Ext.P9<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No.35287 OF 2010   4<\/span><\/p>\n<p>Government Order would be put against the Petitioner.<\/p>\n<p>Ext.P9 is not a general order but an order in the case<\/p>\n<p>of   a  particular    teacher. If   the  petitioner  is<\/p>\n<p>aggrieved by Ext.P9, nothing prevents her from taking<\/p>\n<p>up the issue before the Government in the Revision<\/p>\n<p>which she may file against Ext.P7 staff fixation<\/p>\n<p>order.   The petitioner can also insist the Revisional<\/p>\n<p>power of the Government in accordance with in the<\/p>\n<p>matter of Ext.P8 order.     For that purpose, it is not<\/p>\n<p>necessary to entertain this Writ Petition.<\/p>\n<p>    For the aforesaid reasons, the Writ Petition is<\/p>\n<p>closed   with   liberty  to  the  petitioner  to  avail<\/p>\n<p>alternative    remedy.
