Civil Appeal No.74 of<br \/>\n2008.\n<\/p>\n<p>2.\tThe<br \/>\npetitioner filed the suit and took out injunction application Exh-5<br \/>\nunder Order 39 Rule 1 and 2 and section 151 of the CPC for an order<br \/>\nrestraining the respondents &#8211; defendants from carrying out any<br \/>\ncut canal work in the property bearing survey No.287\/2 belonging to<br \/>\nhis ownership.  The respondents &#8211; defendants appeared and<br \/>\ncontested the injunction application by filing the reply.  After<br \/>\nhearing the learned advocates for the parties, the trial Court<br \/>\ndismissed the injunction application.  Therefore, the petitioner &#8211;<br \/>\nplaintiff filed appeal in the Court of learned District Judge,<br \/>\nVadodara by filing Misc. Civil Appeal No.74 of 2008.  After hearing<br \/>\nlearned advocates for the parties, the first appellate Court<br \/>\ndismissed the appeal and confirmed the order passed by the trial<br \/>\nCourt below injunction application Exh-5.  Being aggrieved by the<br \/>\nsaid decision, the petitioner has approached this Court by way of<br \/>\npresent petition.\n<\/p>\n<p>3.\tI<br \/>\nhave heard learned advocate Mr. Patel for the petitioner at length<br \/>\nand in great detail.\n<\/p>\n<p>4.\tLearned<br \/>\nadvocate Mr. Patel submitted that the respondents have carried out<br \/>\nthe canal work on his property, which has caused damage to his<br \/>\nproperty and therefore, the trial Court committed error in not<br \/>\ngranting injunction as prayed for in the injunction application.  He<br \/>\nhas tried to rely upon the copy of map annexed with the compilation<br \/>\nat page 75 indicating the canal work being carried out.\n<\/p>\n<p>5.\tIt<br \/>\nappears from the order passed by the trial Court that originally, the<br \/>\nsuit land belonged to the ownership of the petitioner and it was<br \/>\nacquired for the purpose of laying down canal and compensation for<br \/>\nsuch acquisition was paid to the owner i.e. the petitioner.  Learned<br \/>\nadvocate Mr. Patel has also admitted that the suit land is acquired<br \/>\nby the authority for the purpose of laying down canal and<br \/>\ncompensation has been paid to the petitioner and he has received the<br \/>\nsame.\n<\/p>\n<p>6.\tIn<br \/>\nview of above, it is clear that the suit land does not belong to the<br \/>\npetitioner and he ceased to be owner of the same, as the same has<br \/>\nbeen acquired by the authority.  Therefore, the trial Court was<br \/>\njustified in refusing to grant relief claimed in the injunction<br \/>\napplication Exh-5 and the first appellate Court committed no error in<br \/>\nconfirming the order.\n<\/p>\n<p>7.\tIn<br \/>\nthe above background, I do not find any reason to interfere with the<br \/>\nimpugned orders.
