No.22989\/2010-W\n                ~~~~~~~~~~~~~~~~~~~~~~~~~~~\n            Dated this the 3rd day of August, 2010\n\n                      J U D G M E N T\n<\/pre>\n<p>    The petitioner seeks for a direction to the Panchayat<\/p>\n<p>to consider and pass orders on the application for building<\/p>\n<p>permit.\n<\/p>\n<p>    2.   The petitioner is the Secretary of Ace Educational<\/p>\n<p>Charitable Trust.    They are proposing to establish an<\/p>\n<p>educational institution in the property in Survey No.1 of<\/p>\n<p>Eranholi Panchayat.   Plan was submitted in March 2010.<\/p>\n<p>Thereafter, a representation has been submitted by the<\/p>\n<p>petitioner to the Secretary of the Panchayat.    Ext.P1 is<\/p>\n<p>the copy   of the  said  communication.     By Ext.P2,  the<\/p>\n<p>petitioner was given a reply to produce various documents,<\/p>\n<p>including a certificate from the Village Officer as to<\/p>\n<p>whether any proceedings under the Land Acquisition Act is<\/p>\n<p>pending or not.  After approaching the Village Officer, the<\/p>\n<p>petitioner  submitted  Ext.P3    letter  stating  that   no<\/p>\n<p>notifications are in force with regard to the acquisition<\/p>\n<p>of the property in question under the Land Acquisition Act<\/p>\n<p>and that   the Village  Officer   has  refused to  issue  a<\/p>\n<p>certificate.\n<\/p>\n<p>    3.   Inspite of receipt of notice, respondent Nos.1 and<\/p>\n<p>2 have not entered appearance through counsel.  The learned<\/p>\n<p>W.P.(C). No.22989\/2010<br \/>\n<span class=\"hidden_text\">                                -:2:-<\/span><\/p>\n<p>counsel for the petitioner submitted that it is unnecessary<\/p>\n<p>to insist on a certificate from the Village Officer and<\/p>\n<p>there is no procedure to issue a certificate as the one<\/p>\n<p>sought for.        It is further pointed out that the Village<\/p>\n<p>Officer     can    certify details   regarding the   change  of<\/p>\n<p>ownership only after an award is passed under Section 18 of<\/p>\n<p>the   Land     Acquisition  Act,    if at  all  there  is   any<\/p>\n<p>proceedings for acquisition.\n<\/p>\n<p>     4.      I find merit in the above submission made by the<\/p>\n<p>learned counsel for the petitioner.        In that view of the<\/p>\n<p>matter, the Panchayat cannot insist for such a certificate<\/p>\n<p>from the Village Officer.        If at all any information is<\/p>\n<p>required by the Panchayat, it is upto the Secretary to seek<\/p>\n<p>information from the Village Officer but, that shall not<\/p>\n<p>stand in the way of the grant of building permit.         There<\/p>\n<p>will be a direction to respondent Nos. 1 and 2 to take a<\/p>\n<p>decision in regard to the grant of building permit and<\/p>\n<p>communicate the same to the petitioner within a period of<\/p>\n<p>one month in the light of the principles stated in <a href=\"\/doc\/1115418\/\">Padmini<\/p>\n<p>v. State of Kerala<\/a> [1999 (3) KLT 465]       wherein it was held<\/p>\n<p>that even a proposal for acquisition cannot be a ground to<\/p>\n<p>reject the application for building permit.<\/p>\n<p>     The writ petition is disposed of as above.
