from\u00a0the\u00a0legal\u00a0department\u00a0of\u00a0the\u00a0Bank\u00a0should\u00a0appear\u00a0before\u00a0us\u00a0and\u00a0explain\u00a0his\u00a0<\/p>\n
role\u00a0and\u00a0responsibility\u00a0in\u00a0both\u00a0the\u00a0delaying\u00a0and\u00a0denying\u00a0the\u00a0information\u00a0in\u00a0this\u00a0<\/p>\n

3.      The\u00a0Appellant\u00a0in\u00a0this\u00a0case\u00a0had\u00a0raised\u00a0a\u00a0large\u00a0number\u00a0of\u00a0queries\u00a0in\u00a0his\u00a0<\/p>\n
RTI\u00a0application,\u00a0mostly\u00a0in\u00a0the\u00a0form\u00a0of\u00a0questions\u00a0on\u00a0a\u00a0variety\u00a0of\u00a0matters.\u00a0The\u00a0<\/p>\n
CPIO\u00a0had\u00a0consulted\u00a0the\u00a0legal\u00a0department\u00a0which\u00a0had\u00a0advised\u00a0that\u00a0since\u00a0the\u00a0<\/p>\n
Appellant \u00a0 had \u00a0 raised \u00a0 queries, \u00a0 this \u00a0 did \u00a0 not \u00a0 come \u00a0 within \u00a0 the \u00a0 purview \u00a0 of\u00a0<\/p>\n

\n information\u00a0 as\u00a0 defined\u00a0 in \u00a0Section\u00a02(f)\u00a0of\u00a0 the\u00a0Right\u00a0to\u00a0 Information\u00a0 (RTI)\u00a0 Act.\u00a0<\/p>\n
Based\u00a0on\u00a0this\u00a0advice,\u00a0the\u00a0CPIO\u00a0had\u00a0denied\u00a0the\u00a0information\u00a0to\u00a0the\u00a0Appellant.<\/p>\n
4.      The\u00a0officer\u00a0concerned\u00a0from\u00a0the\u00a0legal\u00a0department\u00a0of\u00a0the\u00a0bank\u00a0submitted\u00a0<\/p>\n
that\u00a0they\u00a0had\u00a0provided\u00a0their\u00a0views\u00a0on\u00a0the\u00a0RTI\u00a0application\u00a0within\u00a0five\u00a0working\u00a0<\/p>\n
days\u00a0of\u00a0receiving\u00a0it\u00a0from\u00a0the\u00a0CPIO\u00a0and,\u00a0therefore,\u00a0could\u00a0not\u00a0be\u00a0blamed\u00a0for\u00a0any\u00a0<\/p>\n
delay\u00a0in\u00a0the\u00a0case.\u00a0On\u00a0scrutiny\u00a0of\u00a0the\u00a0relevant\u00a0records,\u00a0we\u00a0noted\u00a0that,\u00a0indeed,\u00a0<\/p>\n
the\u00a0reference\u00a0had\u00a0been\u00a0sent\u00a0to\u00a0the\u00a0legal\u00a0department\u00a0late\u00a0and,\u00a0obviously,\u00a0they\u00a0<\/p>\n
cannot\u00a0be\u00a0blamed\u00a0for\u00a0any\u00a0consequent\u00a0delay.\u00a0However,\u00a0the\u00a0fact\u00a0remains\u00a0that\u00a0the\u00a0<\/p>\n
opinion\u00a0given\u00a0by\u00a0the\u00a0legal\u00a0department\u00a0was\u00a0seriously\u00a0flawed.\u00a0Besides,\u00a0the\u00a0legal\u00a0<\/p>\n
department \u00a0 had \u00a0 not \u00a0 explained \u00a0 in \u00a0 any \u00a0 detail \u00a0 as \u00a0 to \u00a0 how \u00a0 the \u00a0 request \u00a0 for\u00a0<\/p>\n
information\u00a0could\u00a0be\u00a0dismissed\u00a0merely\u00a0because\u00a0it\u00a0was\u00a0framed\u00a0in\u00a0the\u00a0shape\u00a0of\u00a0<\/p>\n
questions\u00a0and\u00a0queries.\u00a0The\u00a0Respondent\u00a0argued\u00a0that\u00a0the\u00a0CIC\u00a0itself\u00a0had\u00a0ruled\u00a0in\u00a0<\/p>\n
the \u00a0 past \u00a0 that \u00a0 RTI \u00a0 requests \u00a0 presented \u00a0 in \u00a0 the \u00a0 form \u00a0 of \u00a0 queries \u00a0 need \u00a0 not \u00a0 be\u00a0<\/p>\n
considered\u00a0as\u00a0valid\u00a0request\u00a0for\u00a0information.\u00a0To\u00a0say\u00a0the\u00a0least,\u00a0this\u00a0is\u00a0a\u00a0clear\u00a0<\/p>\n
misreading\u00a0of\u00a0the\u00a0said\u00a0decision\u00a0of\u00a0the\u00a0CIC.\u00a0A\u00a0citizen\u00a0can\u00a0ask\u00a0for\u00a0information\u00a0in\u00a0<\/p>\n
many\u00a0ways,\u00a0especially\u00a0since\u00a0the\u00a0Right\u00a0to\u00a0Information\u00a0(RTI)\u00a0Act\u00a0does\u00a0not\u00a0lay\u00a0<\/p>\n
down\u00a0any\u00a0particular\u00a0format\u00a0for\u00a0seeking\u00a0information.\u00a0The\u00a0bottom\u00a0line\u00a0is\u00a0that\u00a0the\u00a0<\/p>\n
request \u00a0 for \u00a0 information \u00a0 should \u00a0 lead \u00a0 to \u00a0 some \u00a0 available \u00a0 records. \u00a0 Therefore,\u00a0<\/p>\n
whenever\u00a0a\u00a0CPIO\u00a0receives\u00a0an\u00a0application\u00a0requesting\u00a0for\u00a0information,\u00a0he\u00a0must\u00a0<\/p>\n
examine \u00a0 the \u00a0 request, \u00a0 irrespective \u00a0 of \u00a0 the \u00a0 form \u00a0 in \u00a0 which \u00a0 it \u00a0 is \u00a0 phrased, \u00a0 to\u00a0<\/p>\n
determine\u00a0if\u00a0it\u00a0has\u00a0any\u00a0relationship\u00a0to\u00a0any\u00a0available\u00a0records\u00a0in\u00a0the\u00a0possession\u00a0of\u00a0<\/p>\n
the\u00a0public\u00a0authority.\u00a0Viewed\u00a0in\u00a0this\u00a0light,\u00a0many\u00a0of\u00a0the\u00a0queries\u00a0of\u00a0the\u00a0present\u00a0<\/p>\n
Appellant\u00a0would\u00a0clearly\u00a0fall\u00a0in\u00a0the\u00a0category\u00a0of\u00a0information\u00a0as\u00a0defined\u00a0in\u00a0Section\u00a0<\/p>\n
2(f)\u00a0of\u00a0the\u00a0Right\u00a0to\u00a0Information\u00a0(RTI)\u00a0Act.\u00a0Thus,\u00a0the\u00a0opinion\u00a0given\u00a0by\u00a0the\u00a0legal\u00a0<\/p>\n
department\u00a0that\u00a0none\u00a0of\u00a0the\u00a0queries\u00a0of\u00a0the\u00a0Appellant\u00a0would\u00a0fall\u00a0in\u00a0the\u00a0category\u00a0<\/p>\n
of\u00a0information\u00a0is\u00a0both\u00a0wrong\u00a0and\u00a0decidedly\u00a0against\u00a0the\u00a0spirit\u00a0of\u00a0the\u00a0Right\u00a0to\u00a0<\/p>\n
Information\u00a0(RTI)\u00a0Act.\u00a0In\u00a0fact,\u00a0it\u00a0appears\u00a0as\u00a0if\u00a0the\u00a0legal\u00a0department\u00a0tendered\u00a0<\/p>\n

\n such\u00a0opinion\u00a0only\u00a0to\u00a0deny\u00a0the\u00a0information\u00a0to\u00a0the\u00a0Appellant.<\/p>\n
5.      The \u00a0 Respondent \u00a0 also \u00a0 argued \u00a0 that \u00a0 the \u00a0 responsibility \u00a0 of \u00a0 the \u00a0 legal\u00a0<\/p>\n
department\u00a0was\u00a0limited\u00a0only\u00a0to\u00a0giving\u00a0an\u00a0opinion\u00a0and\u00a0it\u00a0was\u00a0for\u00a0the\u00a0CPIO\u00a0to\u00a0<\/p>\n
finally\u00a0decide\u00a0if\u00a0the\u00a0information\u00a0should\u00a0be\u00a0disclosed\u00a0or\u00a0not.\u00a0He\u00a0argued\u00a0that\u00a0the\u00a0<\/p>\n
blame\u00a0for\u00a0not\u00a0disclosing\u00a0the\u00a0information\u00a0could\u00a0not,\u00a0therefore,\u00a0be\u00a0placed\u00a0on\u00a0the\u00a0<\/p>\n
legal\u00a0department.\u00a0There\u00a0is\u00a0some\u00a0merit\u00a0in\u00a0this\u00a0argument.\u00a0After\u00a0all,\u00a0the\u00a0opinion\u00a0of\u00a0<\/p>\n
the\u00a0legal\u00a0department\u00a0was\u00a0not\u00a0binding\u00a0on\u00a0the\u00a0CPIO.\u00a0Thus,\u00a0the\u00a0CPIO\u00a0has\u00a0also\u00a0to\u00a0<\/p>\n
explain\u00a0why\u00a0he\u00a0chose\u00a0not\u00a0to\u00a0disclose\u00a0the\u00a0information.\u00a0In\u00a0order\u00a0to\u00a0resolve\u00a0this\u00a0<\/p>\n
matter,\u00a0we\u00a0would\u00a0like\u00a0to\u00a0hear\u00a0the\u00a0explanation\u00a0of\u00a0both\u00a0the\u00a0CPIO\u00a0and\u00a0the\u00a0relevant\u00a0<\/p>\n
