WADHWA,<br \/>\nJ.(PRESIDENT).\n<\/p>\n<p>\u00a0 <\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>Air India who is the petitioner before us was opposite party No.2 before the<br \/>\nDistrict\u00a0 Forum in a complaint filed by<br \/>\nrespondent Nos.1 &amp; 2 being the father and son.\u00a0 M\/s<br \/>\nGrand Travel Planners (P) Ltd. who is the 3rd respondent before us was<br \/>\nrespondent No.1 before the District Forum.\n<\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>The complaint was that in spite of having a confirmed ticket of Air India issued by<br \/>\nthe Travel Agent Harpreet Singh was denied boarding.\u00a0<br \/>\nDistrict Forum held that there was deficiency in service and awarded Rs.15,000\/- as<br \/>\ncompensation and had also awarded Rs.4,000\/- as travel expenses from Indira Gandhi<br \/>\nInternational Airport (IGIA), Delhi to Connaught Place Offices of the Air India and then<br \/>\nfrom IGIA to Domestic Airport.\u00a0 Complainant<br \/>\nhad claimed expenses for mental agony and physical harassment.\u00a0 In all, District Forum awarded Rs.19,000\/- to the<br \/>\ncomplainant and in case the amount was not paid within one month from the date of receipt<br \/>\nof the order, it will carry interest @ 9% per annum from that date.\u00a0 A sum of Rs.1,000\/- was also awarded as litigation<br \/>\ncost to the complainant. \u00a0Aggrieved from this<br \/>\norder of the District Forum, both the Air India and the Travel Agent filed separate<br \/>\nappeals in the Chandigarh Union Territory.\u00a0 Both<br \/>\nthese appeals were dismissed by the State Commission with cost of Rs.250\/- each.\n<\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>As stated above, the Air India still feels aggrieved and has come before us in this<br \/>\npetition under Section 21(b) of the Consumer Protection Act, 1986.\u00a0\u00a0 Two points have been raised before us &#8211; (1)<br \/>\nthat travel agent was not the agent of Air India thought he was agent of IATA<br \/>\n(International Air Transport Association) and (2) ticket was not re-confirmed by the<br \/>\npassenger.\u00a0 Both these points are without<br \/>\nsubstance.\u00a0\u00a0 Travel agent was the<br \/>\naccredited agent of IATA of which Air India is a Member.\u00a0<br \/>\nAn argument that Air India could not suffer for the fault of the agent is against<br \/>\nthe basic principles of law particularly against the provisions of the Contract Act.\u00a0 Air India is certainly liable for the negligence<br \/>\nof its agent.\u00a0 Ticket was purchased on<br \/>\n23.2.1999 and Harpreet Singh, the passenger, was to take the flight on 25.2.1999, within<br \/>\n72 hours of purchase of the okay ticket.\u00a0 There<br \/>\nwas no question of any re-confirmation when travel agent had issued a ticket with<br \/>\nconfirmed status.\u00a0 Harpreet Singh was to join<br \/>\nuniversity in Sydney on 1.3.1999 for higher studies.\u00a0<br \/>\nWe have not been shown any condition requiring confirmation in a case like the<br \/>\npresent one.\u00a0\n<\/p>\n<p>\u00a0 <\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>Then it is submitted before us that the agent did not pass on the information to<br \/>\nAir India and did not indicate the ticket number within the stipulated period with the<br \/>\nresult that Air India had cancelled the ticket after expiry of the time limit for not<br \/>\nproviding the ticket number.\u00a0 Then the fact<br \/>\nremains that the ticket was sold by the travel agent and it was confirmed by Central<br \/>\nReservation System (SABRE) of Air India.\u00a0 In<br \/>\nany case complainant is not concerned with the interse functioning of the travel agent and<br \/>\nthe air carrier when travel agent is the agent of the carrier.\n<\/p>\n<p>\u00a0 <\/p>\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n<p>We do not find any ground to interfere with the order of the District Forum as also<br \/>\nof the State Commission.\u00a0 This Revision<br \/>\nPetition is dismissed.\n<\/p>\n<p>\u00a0 <\/p>\n<p>&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;J<\/p>\n<p>(D.P.
