Forest Act, 1967 (the &#8216;Act&#8217;), before the II Metropolitan<br \/>\nMagistrate, Hyderabad on the ground that he along with another<br \/>\nperson was transporting sandalwood pieces numbering 30,000 in a<br \/>\nlorry on 7.8.1982 from Hyderabad to Bombay. The said<br \/>\ntransportation was alleged to be without permit and in<br \/>\ncontravention of the Act and the Rules, stated herein above.<br \/>\n\tThe trial court after considering the evidence on record came<br \/>\nto the conclusion that the appellant is a licensed dealer and stockist<br \/>\nin sandalwood and the sandalwood pieces found during the<br \/>\ntransportation were not actually sandalwood as defined under<br \/>\nSection 2(o) of the Act but were products obtained after conversion<br \/>\nof the original sandalwood to certain shapes which are meant for<br \/>\nthe purpose of being used as handles in other finished sandalwood<br \/>\nproducts and there being no requirement of law to obtain any<br \/>\npermit for transportation of such finished sandalwood products,<br \/>\nfound the appellant not guilty of offences charged against him,<br \/>\nhence, acquitted him with a direction that the material objects,<br \/>\nnamely, the sandalwood pieces seized should be returned to the<br \/>\nappellant.\n<\/p>\n<p>\tIn appeal, the High Court took a contrary view of the matter<br \/>\nand came to the conclusion that even if the goods seized were<br \/>\nproducts made out of sandalwood, the same required transit permit,<br \/>\notherwise there is every likelihood of a person contravening the<br \/>\nprovisions of the Rules if such goods are transported without the<br \/>\nknowledge of the authorities. On the said basis, it reversed the<br \/>\nfindings of the trial court and found the appellant guilty of having<br \/>\ncontravened Rule 3 of the Rules consequently held him liable for<br \/>\npunishment under section 29(4)(a)(i) of the Act and imposed a<br \/>\nsentence of three months simple imprisonment with a fine of<br \/>\nRs.2,000\/-. The High Court also directed M.Os 1 to 125 to be<br \/>\nconfiscated to the Government. In this appeal, though the appellant<br \/>\nhad died and the punishment imposed on him had abated, the<br \/>\nappeal is pursued by the legal representatives of the deceased<br \/>\nappellant because of the order of confiscation made by the High<br \/>\nCourt.\n<\/p>\n<p>\tShri Kavin Gulati, learned counsel appearing for the<br \/>\nappellant contended while the trial court was justified in coming to<br \/>\nthe conclusion that the finished sandalwood product did not require<br \/>\ntransit permit, the High Court erred in proceeding on a<br \/>\npresumption that such a permit is necessary even though the<br \/>\nprosecution had failed to establish that in law such a permission<br \/>\nwas necessary. Learned counsel contended the finding of the High<br \/>\nCourt that a transit permit for transportation of finished<br \/>\nsandalwood is necessary because, otherwise there would be every<br \/>\nlikelihood of circumventing the provisions of law is a ground<br \/>\nwhich is not sustainable in law. In support of this contention, he<br \/>\nrelied on a judgment of this Court in <a href=\"\/doc\/155648\/\">Suresh Lohiya vs. State of<br \/>\nMaharashtra &amp; Anr.<\/a> (1996 10 SCC 397) wherein this Court while<br \/>\nconsidering a similar argument in regard to transportation of<br \/>\nbamboo, had held that a conviction based on such presumption is<br \/>\nunsustainable in law. Shri Prabhakar, learned counsel appearing for<br \/>\nthe respondent-State primarily contended that the material seized<br \/>\nby the authorities were in fact sandalwood as defined under<br \/>\nSection 2(o) of the Act and merely because some conversion is<br \/>\nmade on this sandalwood the same would not become finished<br \/>\ngoods and would still remain to be sandalwood as defined under<br \/>\nthe Act. Therefore, a transit permit is necessary for transportation<br \/>\nof such sandalwood. He also contended that the High Court was<br \/>\njustified in protecting the interest of the State by requiring a transit<br \/>\npermit to be taken while transporting such sandalwood.<br \/>\n\tAs noticed above, the original appellant was a holder of a<br \/>\nlicence to deal in and stock sandalwood. From the material on<br \/>\nrecord, it is seen that the said appellant had obtained necessary<br \/>\npermit from the competent authorities for converting the<br \/>\nsandalwood purchased by him into various types of handles which<br \/>\nis ultimately used in other sandalwood handicrafts which<br \/>\npermission was valid upto 31st of December, 1982 period covering<br \/>\nthe period of seizure. The appellant had contended that it is<br \/>\npursuant to the said permission he had converted the sandalwood<br \/>\npellets into handles to be used in the other sandalwood artifacts<br \/>\nand he had informed the concerned authorities about such<br \/>\nconversion as per Ex.P-18 to P-27. It is also the case of the<br \/>\nappellant that converted sandalwood artifacts or parts thereof do<br \/>\nnot require any transit permit and it is only sandalwood in its<br \/>\noriginal form or chips and powder of sandalwood which requires a<br \/>\ntransmit permit. The trial Court has agreed with this submission of<br \/>\nthe appellant. We also notice under the Rules and the Act what is<br \/>\nprohibited is the transportation of sandalwood as defined in<br \/>\nSection 2(o) of the Act and not sandalwood products which have<br \/>\nbeen converted into such products after obtaining proper<br \/>\npermission from the authorities. Such converted sandalwood<br \/>\nproduct under the Rules do not require any transmit permit. We say<br \/>\nso because Rules referred to in these proceedings do not<br \/>\ncontemplate such transmit permit and the respondents have not<br \/>\nproduced any other Rules to show such transit permit is required.<br \/>\nOn the contrary, the respondent argues that even converted<br \/>\nsandalwood products require transit permit because they remained<br \/>\nto be sandalwood as contemplated under Section 2(o) of the Act. In<br \/>\nthe absence of any specific Rules or provisions in the Act to this<br \/>\neffect, we are unable to agree with this argument. We are of the<br \/>\nopinion once sandalwood is subjected to certain process from<br \/>\nwhich a sandalwood product is lawfully obtained, then such<br \/>\nproduct ceases to be sandalwood as understood in Section 2(o) of<br \/>\nthe Act.\n<\/p>\n<p>The High Court, however, proceeded on the basis that if<br \/>\nsuch a restriction on transport of sandalwood product is not<br \/>\ninferred then there is likelihood of evasion of the provisions of the<br \/>\nAct, therefore, it proceeded on an inference that such transit permit<br \/>\nis necessary in law. We are unable to accept this reasoning of the<br \/>\nHigh Court which as rightly contended by the learned counsel for<br \/>\nthe appellant cannot be sustained. We are supported in this view of<br \/>\nours by the judgment of this Court in the case of Suresh Lohiya<br \/>\n(supra)<br \/>\n For the reasons stated above, we are of the opinion that the<br \/>\nrespondents have failed to prove that the deceased appellant had<br \/>\ncommitted any such offence as charged against him, therefore, this<br \/>\nappeal must succeed.\n<\/p>\n<p>\tFor the reasons stated above, this appeal is allowed, the<br \/>\nimpugned judgment of the High Court is set aside as that of the<br \/>\ntrial court is restored. The respondent State shall return the<br \/>\nmaterial objects seized from the deceased appellant, the same shall<br \/>\nbe handed over to the legal representatives of the said deceased<br \/>\nappellant within three months from today.
