Civil<br \/>\nAppeal No. 119 of 1998 below Exhibits 186 and 193 by the learned 4th<br \/>\nFast Track Court, at Surat, whereby the learned trial Judge rejected<br \/>\nthe application seeking permission for production of certain<br \/>\ndocuments on record of the case.\n<\/p>\n<p>2.\t\tThe<br \/>\nshort facts of the case are that the petitioners and one Kantibhai<br \/>\nSomabhai Tailor (since deceased) had approached the Charity<br \/>\nCommissioner and had prayed for certain reliefs under the provisions<br \/>\nof Bombay Public Trusts Act, 1950, as the petitioners had the<br \/>\ngrievance that one Kshetrapal Hanumanji Mandir, Surat was not<br \/>\nmaintaining the accounts of the Trust properly and that certain<br \/>\nirregularities had been committed in the maintenance of the<br \/>\naccounts.  Thereafter, the petitioners preferred application<br \/>\npresenting scheme before the concerned authority.  The petitioners<br \/>\nhad also preferred an application  for carrying out detailed inquiry<br \/>\ninto the alleged irregularities committed in the accounts and for the<br \/>\nappointment of a Commissioner for taking accounts of the income of<br \/>\nthe temple in question.  However, the said application was rejected.\n<\/p>\n<p>2.1.\t\tThereafter,<br \/>\nthe petitioner preferred an appeal being Misc. Civil Appeal No. 119<br \/>\nof 1998 under the provisions of Section 72(1) of the Bombay Public<br \/>\nTrusts Act, before the learned 4th Fast Track Court,<br \/>\nSurat. During the pendency of the said appeal, the petitioners came<br \/>\ninto possession of certain important documents in respect of certain<br \/>\nalleged irregularities committed by the respondents in maintaining<br \/>\nthe accounts.\n<\/p>\n<p>2.2.\t\tPursuant<br \/>\nthereto, the petitioners preferred applications in this regard, below<br \/>\nExhibits 186 and 193, in the said appeal seeking permission for<br \/>\nproduction of the said documents on record of the case. However, the<br \/>\nlearned trial Judge, vide order dated 18.07.2005, rejected the said<br \/>\napplications. Hence, this petition.\n<\/p>\n<p>3.\t\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. On perusal of the documents on record it transpires that<br \/>\nthe documents in question were not relevant to the facts of the case<br \/>\nbefore the trial Court inasmuch as the petitioners were not<br \/>\nable to explain as to why they were not able to produce the said<br \/>\ndocuments at an earlier point of time, particularly when the appeal<br \/>\nis of the year 1998.\n<\/p>\n<p>4.\t\tIn<br \/>\nview of the above, the trial Court came to the conclusion that the<br \/>\nsaid documents were not relevant to the facts of the case and<br \/>\nconsequently, rejected the applications. I am in complete agreement<br \/>\nwith the reasonings given by the Court below while rejecting the<br \/>\napplication of the petitioners and hence I find no reason to<br \/>\ninterfere with  the same under Article 226 of the Constitution of<br \/>\nIndia.\n<\/p>\n<p>5.\t\tIn<br \/>\nthe result, the petition is dismissed. Rule is discharged.
