M. SAHAI)<\/p>\n<p>\tWe<\/a><br \/>\n\thave heard Mr. Y. V. Shah, learned counsel for the petitioner.\n<\/p>\n<p>\tThis<br \/>\n\twrit petition has been filed challenging the judgment dated<br \/>\n\t11.04.2011 passed by Central Administrative Tribunal, Ahmedabad<br \/>\n\tBench, Ahmedabad (for short &#8216;the Tribunal&#8217;) in Original Application<br \/>\n\tNo.358 of 2009 whereby the Tribunal rejected the said application<br \/>\n\tfiled by the petitioner.\n<\/p>\n<p>\tThe<br \/>\n\tpetitioner was appointed on compassionate grounds as Train Clerk on<br \/>\n\t05.06.1991.  He was promoted to the higher post of Senior TNC on<br \/>\n\t20.08.1994.  He was further promoted as Goods Guard on 03.12.1999.<br \/>\n\tDuring the year 2008, the petitioner had to undergo bye-pass surgery<br \/>\n\ton account of unbearable strain and pressure of work as Goods Guard.<br \/>\n\t He was referred to the Chief Medical Superintendent for medical<br \/>\n\texamination in the year 2008.  He was medically de-categorised for<br \/>\n\tA\/2 and below and was recommended for permanent job change of job<br \/>\n\tnot involving train running and train passing duties.  The<br \/>\n\tpetitioner was thereafter posted as Head Clerk by the order dated<br \/>\n\t04.12.2008. The petitioner did not report for duty as per the said<br \/>\n\tposting order, but submitted a representation for posting as Head<br \/>\n\tTTE. The petitioner appeared before the Screening Committee on<br \/>\n\t22.01.2009 and specifically demanded before the Screening Committee<br \/>\n\tthat he is entitled to get posting as Deputy CTI \/ Head TTE in the<br \/>\n\tpay scale of Rs.5500 &#8211; 9000.  Thereafter, the petitioner has<br \/>\n\tbeen making repeated representations for posting as TTE, but<br \/>\n\trespondents have not acceded to the request.  Therefore, the<br \/>\n\tpetitioner filed Original Application No.358 of 2009 before the<br \/>\n\tTribunal for quashing the posting order dated 04.12.2008 and for a<br \/>\n\tdirection to post the petitioner against any vacant posts of Deputy<br \/>\n\tCTI, TTI or Head TTE carrying the pre-revised pay scale of Rs.5500 &#8211;<br \/>\n\t9000 with effect from the date of medical de-categorisation.\n<\/p>\n<p>\tThe<br \/>\n\tTribunal considered the Instructions of the Railway Board dated<br \/>\n\t11.12.2009 and 31.12.2001 and dismissed the Original Application<br \/>\n\tfiled by the petitioner after recording the finding that even if<br \/>\n\tthere are vacancies of TTE, it does not give a right to the<br \/>\n\tpetitioner to ask that he should be given that post as an<br \/>\n\talternative appointment.  The law prescribes that in cases of<br \/>\n\tmedical de-categorisation, the employee does not have a right to<br \/>\n\tclaim post of his choice, but it is for the respondents to provide<br \/>\n\tfor alternative employment to the petitioner in accordance with the<br \/>\n\tmedical certificate and there is no material loss of salary in the<br \/>\n\tnew employment to the petitioner.\n<\/p>\n<p>\tLearned<br \/>\n\tcounsel for the petitioner has urged that in view of Section 47 of<br \/>\n\tthe Persons with Disabilities (Equal Opportunities, Protection of<br \/>\n\tRights and Full Participation) Act, 1995 (hereinafter referred to as<br \/>\n\t&#8216;the Act&#8217;), the petitioner was entitled for the post for which he<br \/>\n\twas claiming and he should not be given the alternative post as has<br \/>\n\tbeen given by the respondents.\n<\/p>\n<p>\tFor<br \/>\n\tappreciating the argument of learned counsel for the petitioner, it<br \/>\n\tis necessary to extract Section 47 of the Act, which reads as under<br \/>\n\t:-\n<\/p>\n<p>&#8220;47.\tNon-discrimination<br \/>\nin Government \temployment :-\n<\/p>\n<p>(1)\tNo<br \/>\nestablishment shall dispense with, or reduce in rank, an employee who<br \/>\nacquires a disability during his service:\n<\/p>\n<p>Provided that,<br \/>\nif an employee, after acquiring disability is not suitable for the<br \/>\npost he was holding, could be shifted to some other post with the<br \/>\nsame pay scale and service benefits;\n<\/p>\n<p>Provided<br \/>\nfurther that if it is not possible to adjust the employee against any<br \/>\npost, he may be kept on a supernumerary post until a suitable post is<br \/>\navailable or, he attains the age of superannuation, whichever is<br \/>\nearlier.\n<\/p>\n<p>(2)\tNo<br \/>\npromotion shall be denied to a person merely on the ground of his<br \/>\ndisability;\n<\/p>\n<p>Provided that<br \/>\nthe appropriate Government may, having regard to the type of work<br \/>\ncarried on in any establishment, by notification and subject to such<br \/>\nconditions, if any, as may be specified in such notification, exempt<br \/>\nany establishment from the provisions of this section.&#8221;\n<\/p>\n<p>\tA<br \/>\n\tperusal of the Section demonstrates that services of an employee<br \/>\n\tshall not be dispense with or reduced in rank, where an employee<br \/>\n\tacquires disability during his service. It further provides that the<br \/>\n\temployee, after acquiring disability is not suitable for the post he<br \/>\n\twas holding, he could be shifted to some other post on the same pay<br \/>\n\tscale and service benefits.  The Act further provides that no<br \/>\n\tpromotion shall be denied to a person merely on the ground of his<br \/>\n\tdisability.  Sub-section (1) of Section 47 clearly lays down that<br \/>\n\tthe employee having disability has to be shifted to some other post,<br \/>\n\tbut his pay scale and service benefits could not be reduced.\n<\/p>\n<p>\tThe<br \/>\n\tpetitioner has made representation claiming the post of his choice.<br \/>\n\tThe representation was unfounded as the petitioner has already been<br \/>\n\toffered the post of Head Clerk.  Therefore, it was not necessary for<br \/>\n\tthe respondents to offer any other post once they have offered the<br \/>\n\tpost of Head Clerk to the petitioner.\n<\/p>\n<p>It<br \/>\n\tis not the case of the petitioner that his pay scale or service<br \/>\n\tbenefits has been reduced.  Learned counsel Mr. Y.V. Shah for the<br \/>\n\tpetitioner has urged that the post offered to the petitioner by the<br \/>\n\trespondents would mar his chances for promotion.  The argument does<br \/>\n\tnot appear to have any force.  The Act itself protects the<br \/>\n\tpetitioner and Section 47 (2) clearly provides that no promotion<br \/>\n\tshall be denied to a person merely on the ground of his disability.<br \/>\n\tSince the petitioner has incurred medical disability, he has been<br \/>\n\toffered alternative<br \/>\n\tappointment by the respondents.  It is not open to the employee to<br \/>\n\tchoose alternative appointment and to claim that he may be appointed<br \/>\n\tto a particular post.  It is the discretion of the respondents to<br \/>\n\tappoint the disabled person on such post as they think fit as per<br \/>\n\tthe medical certificate and since the petitioner has been appointed<br \/>\n\tas Head Clerk by order dated 04.12.2008 and his pay scale has not<br \/>\n\tbeen reduced nor his service benefits have been reduced, we do not<br \/>\n\tfind any illegality in the impugned order passed by the Tribunal.<br \/>\n\tThis writ petition fails and is accordingly dismissed summarily.\n<\/p>\n<p>\t\t\t\t\t\t\t\t\t\t                                Sd\/-\n<\/p>\n<p>\t\t\t\t\t\t\t\t[V.
