{"id":12339,"date":"2010-07-26T00:00:00","date_gmt":"2010-07-25T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/mr-shyam-sunder-vs-department-of-personnel-and-on-26-july-2010"},"modified":"2017-04-06T19:06:33","modified_gmt":"2017-04-06T13:36:33","slug":"mr-shyam-sunder-vs-department-of-personnel-and-on-26-july-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/mr-shyam-sunder-vs-department-of-personnel-and-on-26-july-2010","title":{"rendered":"Mr.Shyam Sunder vs Department Of Personnel And &#8230; on 26 July, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Central Information Commission<\/div>\n<div class=\"doc_title\">Mr.Shyam Sunder vs Department Of Personnel And &#8230; on 26 July, 2010<\/div>\n<pre>                   CENTRAL INFORMATION COMMISSION\n               Complaint No. - CIC\/WB\/C\/2009\/000203 dated: 24.02.'09\n                    Right to Information Act- Section 18\n\nComplainant:        Shri Shyam Sunder\nRespondent:         Department of Personnel &amp; Training (DoP&amp;T), New Delhi.\n                        Decision announced 26.7.'10\nFacts<\/pre>\n<p>:-\n<\/p>\n<p>      The Commission has received a complaint from Shyam Sunder of<br \/>\nAllahabad, Uttar Pradesh that his request submitted to the Central Public<br \/>\nInformation Officer, Department of Personnel &amp; Training, New Delhi, seeking<br \/>\ninformation regarding financial up-gradation under revised ACP scheme which he<br \/>\nshould get in light of his service conditions as stated in the application, has not<br \/>\nbeen responded to, although the same was duly submitted along with requisite<br \/>\nfee dated 05.01.2009.\n<\/p>\n<p>      Admitting the complaint of Shri Shyam, the Commission served notice on<br \/>\nCPIO, DoP&amp;T, New Delhi on 01.04.2010 for furnishing comments on the<br \/>\ncomplaint. In his response CPIO, Shri A. K. Srivastava, Under Secretary, DoP&amp;T,<br \/>\nNew Delhi submitted his comments on 16.04.2010 with a copy endorsed to<br \/>\ncomplainant. The CPIO has informed the Commission that the application dated<br \/>\n05.01.2009 of the complainant was received on 27.01.2009 and was responded<br \/>\nto by him on 19.02.2009. CPIO has further submitted that on receipt of a copy of<br \/>\ncomplaint dated 24.02.2009 from Shri Shyam Sunder to CIC, the factual position<br \/>\nwas also informed to CIC with a copy to Shri Shyam Sunder vide letter dated<br \/>\n18.03.2009. The CPIO has enclosed the copies of relevant letters sent to the<br \/>\ncomplainant with his comments.\n<\/p>\n<p>                                Decision Notice<br \/>\n      From a perusal of the facts before us in the comments of the CPIO it is<br \/>\nclear that the application dated 05.01.2009 of the complainant has been<br \/>\nresponded to by the CPIO and that within the time mandated by the law. Hence,<\/p>\n<p><span class=\"hidden_text\">                                        1<\/span><br \/>\n the complaint for failure to respond to the request does not stand and is hereby<br \/>\ndismissed.\n<\/p>\n<p>       The complainant is hereby advised that should he find the response<br \/>\nunsatisfactory, he might approach the 1st appellate authority of the DoPT and<br \/>\nconsequently, if not satisfied with the information provided on his 1st appeal he<br \/>\nwill be at liberty to file 2nd appeal before us u\/s 19(3) of the Act.\n<\/p>\n<p>       Announced on this twenty-sixth day of July 2010 in open chambers.<br \/>\nNotice of this decision be given free of cost to the parties.\n<\/p>\n<p>Wajahat Habibullah<br \/>\n(Chief Information Commissioner)<br \/>\n26.07.2010<\/p>\n<p>Authenticated true copy, additional copies of order shall be supplied against<br \/>\napplication and payment of the charge prescribed under the Act to the CPIO of<br \/>\nthis Commission.\n<\/p>\n<p>Pankaj K.
