Subhash Chandra Agarwal, J.\n<\/p>\n<p>       This Habeas Corpus Petition has been filed for setting-aside<br \/>\nthe order of detention passed against the petitioner       Rajvir @<br \/>\nBhola under Section 3 (2) of the National Security Act dated 20-1-<br \/>\n2009 by District Magistrate, Baghpat.\n<\/p>\n<p>       The detention order was passed on the grounds that on<br \/>\n10.12.2008, at about 6.30 p.m. at Agarwal Mandi, Tatiri Bazar,<br \/>\nRajvir @ Bhola and his companions, in order to extort money,<br \/>\nopened fire at Kishan Chand, Sanjay, Raj Kumar, Sumant Prasad,<br \/>\nNitin, Brajmohan Gupta and Pramod Gupta resulting in the death<br \/>\nof Kishan Chand, Sumant Prasad, Sanjay and Brajmohan Gupta<br \/>\nand injuries to other three persons. As a result of such daring act,<br \/>\nthe feeling of fear and panic was developed in the public mind and<br \/>\npublic order was distrubed. The District Magistrate apprehended<br \/>\nthat the bail would be granted to the petitioner by the Court and<br \/>\nthere was apprehension that the petitioner would again involve<br \/>\nhimself in the aforesaid criminal activities affecting public orders,<br \/>\nhence it was thought necessary to preventively detain the<br \/>\npetitioner.\n<\/p>\n<p>       We have heard Sri Anil Srivastava, learned counsel for the<br \/>\npetitioner, Sri Sudhir Mehrotra, learned counsel for the respondent<br \/>\nnos. 1, 2 and 3 and Sri       Mansoor Ahmad, learned counsel for<br \/>\nrespondent no.4.\n<\/p>\n<p>       The learned counsel for the petitioner has confined himself<br \/>\nto one submission that the representation of the petitioner dated 6-<br \/>\n2-2009 which was submitted to various authorities including the<br \/>\nCentral Government through jailor, was considered with inordinate<br \/>\ndelay by the Central Government.\n<\/p>\n<p>       It was pointed out that the District Magistrate forwarded the<br \/>\npetitioner&#8217;s representation with his comments on 26.2.2009, to the<br \/>\nState Government after obtaining the comments from the S.P.\n<\/p>\n<p><span class=\"hidden_text\">                                                                    2<\/span><\/p>\n<p>Baghpat. It was submitted that the State Government received the<br \/>\nrepresentation on 2.3.2009 and even rejected the same on<br \/>\n5.3.2009. This shows that the State Government disposed of the<br \/>\nrepresentation of the petitioner with utter promptness.\n<\/p>\n<p>       In the counter affidavit filed on behalf of Union of India by<br \/>\nthe under Secretary, Ministry of Home and Affairs, Government of<br \/>\nIndia, it was submitted that the representation of the petitioner was<br \/>\nreceived by the Ministry of Home Affairs on 6.2.2009. After being<br \/>\nprocessed at the levels of under Secretary and Joint Secretary, the<br \/>\nrepresentation was submitted to the Union Home Secretary, who<br \/>\nconsidered the same and rejected it. The decision of the Home<br \/>\nSecretary was communicated to the detenue through wireless<br \/>\nmessage dated 17.4.2009.\n<\/p>\n<p>       In the counter affidavit filed on behalf of the respondent<br \/>\nno.4, it has not been disclosed as to on which date, the<br \/>\nrepresentation of the petitioner was rejected by the Home<br \/>\nSecretary. Only the date of communication of the decision has<br \/>\nbeen given as 17.4.2009. It can, thus, be inferred that the<br \/>\nrepresentation of the petitioner was rejected by the Central<br \/>\nGovernment on 17.4.2009. The representation was received by the<br \/>\nCentral Government on 6.2.2009. It took Central Government 2<br \/>\nmonths and 11 days to consider and reject the representation of<br \/>\nthe petitioner. No explanation for this inordinate delay has been<br \/>\ngiven in the counter affidavit.\n<\/p>\n<p>       <a href=\"\/doc\/468004\/\">In Rajammal V. State of Tamil Nadu, AIR<\/a> 1999 SC 684<br \/>\nwhere consideration of the representation had been delayed<br \/>\nmerely because the Minister was on tour, it was held to be an<br \/>\nunjustified ground for permitting violation of the fundamental rights<br \/>\nof liberty of a citizen guaranteed under Article 21 of the<br \/>\nConstitution, as the said file could easily have been forwarded to<br \/>\nthe Minister. The said decision mentions that &#8220;absence of Minister<br \/>\nat the Headquarters is not sufficient to justify the delay, since the<br \/>\nfile could be reached to the Minister with utmost promptitude in a<br \/>\ncase involving the vital fundamental right of the citizen.&#8221;\n<\/p>\n<p>       The absence of dealing clerk of NSA Desk in February, 2009<br \/>\ndue to long leave and delay in consideration of NSA matters was very<br \/>\nseriously viewed by another Bench of this Court in Pranshu Dutt<br \/>\nDwivedi Vs. Superintendent District Jail, Fatehgarh, Farrukhabad<br \/>\nand others, 2009 (67) ACC 83.\n<\/p>\n<p>       We find that this inordinate delay of 2 months and 11 days in<br \/>\n<span class=\"hidden_text\">                                                                    3<\/span><\/p>\n<p>disposal of the representation of the petitioner by the Central<br \/>\nGovernment has not been adequately and reasonably explained by<br \/>\nthe Central Government. We are conscious of the fact that the<br \/>\nallegations against the petitioner are of a very serious nature but<br \/>\nwhen it is decided to preventively detain a person by depriving him<br \/>\nof his right of personal freedom, the due process of law has to be<br \/>\nobserved. The manner in which the representation of the petitioner<br \/>\nremained pending before the Central Government for a very long<br \/>\nperiod, is shocking to the conscience of the Court. In these<br \/>\ncircumstances, we have no option but to quash the continued<br \/>\ndetention of the petitioner.\n<\/p>\n<p>       The writ petition is allowed.
