It is the case of the<br \/>\npetitioner that the respondent voluntarily abandoned the duties with<br \/>\neffect from 13.01.1993 and in spite of that he raised a dispute,<br \/>\nwhich, ultimately, culminated into a reference before the Court<br \/>\nbelow. During the pendency of the said reference, the respondent<br \/>\nattained the age of superannuation. Therefore, the Court below, while<br \/>\nholding the action of termination of the petitioner to be bad in law,<br \/>\ndirected the petitioner to pay the respondent 40% back wages for the<br \/>\nperiod from the date of his termination to the date of his attaining<br \/>\nthe age of superannuation. Being aggrieved by the said award, the<br \/>\npetitioner has preferred the present petition.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned counsel for the petitioner and perused the documents on<br \/>\nrecord.\n<\/p>\n<p>4.\tThough<br \/>\nserved none appears on behalf of the respondent.\n<\/p>\n<p>5.\tWhile<br \/>\nawarding the back wages, the Court below has not given any cogent<br \/>\nreasons. It has simply proceeded on the footing that since the action<br \/>\nof the petitioner terminating the services of the respondent has been<br \/>\nfound to be illegal, the respondent is entitled for the back wages.\n<\/p>\n<p>6.<br \/>\n\tLooking to the facts of the case, it would be relevant to refer to a<br \/>\ndecision of the Apex Court in the case of Ram Ashrey Singh v.<br \/>\nRam Bux Singh, (2003) II L.L.J. Pg.176. In that<br \/>\ncase, it has been held that a workman has no automatic entitlement to<br \/>\nback wages since it is discretionary and has to be dealt with in<br \/>\naccordance with the facts and circumstances of each case. Similar<br \/>\nprinciple has also been laid down by the Apex Court in the case of<br \/>\nGeneral Manager, Haryana Roadways v. Rudhan Singh,<br \/>\nJ.T. 2005 (6) S.C.,pg. 137, [2005 \/(5) S.C.C.,pg.591],<br \/>\nwherein, it has been held that an order for payment of back wages<br \/>\nshould not be passed in a mechanical manner but, a host of factors<br \/>\nare to be taken into consideration before passing any such order.\n<\/p>\n<p>7.<br \/>\nIt another decision of the Apex Court in the case of <a href=\"\/doc\/1910753\/\">A.P. State<br \/>\nRoad Transport &amp; Ors., v. Abdul Kareem,<\/a> (2005) 6 S.C.C. pg.36,<br \/>\nit has been held that a workman is not entitled to any consequential<br \/>\nrelief on reinstatement as a matter of course unless specifically<br \/>\ndirected by forum granting reinstatement.\n<\/p>\n<p>8.\tConsidering<br \/>\nthe facts of the case and the principle laid down by the Apex Court<br \/>\nin the above decisions, I am of the opinion that the<br \/>\nrespondent-workman cannot be said to be entitled for any back wages.<br \/>\nHence, the impugned award grating back wages deserves to be quashed<br \/>\nand set aside.\n<\/p>\n<p>9.\tFor<br \/>\nthe foregoing reasons, the petition is allowed. The impugned award<br \/>\npassed by the Court below is quashed and set aside. It is, however,<br \/>\nclarified that since the respondent has already retired from service,<br \/>\nthe petitioner shall pay the retirement benefits within a period of<br \/>\nthree months from today, if the same has not been paid so far.
