BASANT, J.\n\n               -------------------------------------------------\n\n                        Tr.P.(Cri) NO. 39 OF 2007\n\n               -------------------------------------------------\n\n              Dated this the 20th day of March, 2007\n\n\n                                    ORDER\n<\/pre>\n<p>        The petitioner is the complainant in a prosecution, inter<\/p>\n<p>alia,   under   Sec.498A   of   the   IPC   pending   before   the   Judicial<\/p>\n<p>Magistrate of the First Class-I, Aluva.   Proceedings have been<\/p>\n<p>initiated on the basis of the complaint filed by her before the<\/p>\n<p>learned   Magistrate.       Cognizance   has   been   taken.         The<\/p>\n<p>respondents\/accused   have   already   entered   appearance<\/p>\n<p>through   counsel.       The   short   prayer   of   the   petitioner   is   that<\/p>\n<p>the   case   may   be     transferred   to   any   other   court   at   the<\/p>\n<p>neighbouring District  Kottayam at Ettumanoor.<\/p>\n<p>        2.     What is  the ground?       The  short contention of the<\/p>\n<p>petitioner is that she is being intimidated by the respondents\/<\/p>\n<p>accused.      In these circumstances,   a fair trial is not possible<\/p>\n<p>at   the   Court   of   the   Judicial   Magistrate   of   the   First   Class   -I,<\/p>\n<p>Aluva, and it is prayed that there may be a transfer as prayed<\/p>\n<p>for.\n<\/p>\n<\/p>\n<p>        3.   It is not necessary that the petitioner must appear on<\/p>\n<p><span class=\"hidden_text\">Tr.P.(Cri) NO. 39 OF 2007               -: 2 :-<\/span><\/p>\n<p>every   date   of   posting   before   the   learned   Magistrate.       The<\/p>\n<p>petitioner&#8217;s personal appearance need be insisted only when the<\/p>\n<p>evidence is to be recorded or for any other reason to be specified<\/p>\n<p>by   the   learned   Magistrate.       I   am   satisfied   that   sufficient<\/p>\n<p>circumstances   are   not   brought   out   to   justify   the   prayer   for<\/p>\n<p>transfer.     The  interests  of  justice  shall  be  eminently   served  by<\/p>\n<p>directing that the learned Magistrate must permit the petitioner<\/p>\n<p>&#8211; a woman\/complainant, to be represented by her counsel on all<\/p>\n<p>dates   of   posting   other   than   dates   on   which   day   her   personal<\/p>\n<p>presence is necessary for the progress of the trial.    The learned<\/p>\n<p>Magistrate shall issue specific directions showing the reason for<\/p>\n<p>her   personal   presence   if   necessary.       It   shall   be   open   to   the<\/p>\n<p>petitioner to complain to the police of any interference\/threat to<\/p>\n<p>her right to appear peacefully before the learned Magistrate and<\/p>\n<p>take part of the proceedings.\n<\/p>\n<\/p>\n<p>        4.       With   the   above   observations,   this   transfer   petition   is<\/p>\n<p>dismissed.\n<\/p>\n<\/p>\n<p>        5. Hand over a copy of this order to the learned counsel for<\/p>\n<p>the petitioner.\n<\/p>\n<\/p>\n<p>                                                    (R.
