ABDUL REHIM, J\n                 -------------------------------\n                WP(C) NO. 34150 OF 2010\n               -------------------------------------\n         Dated this the 29th day of November, 2010\n\n\n                         JUDGMENT\n<\/pre>\n<p>      Challenge    in    this    Writ    Petition   is against<\/p>\n<p>proceedings initiated under the Securitistation and<\/p>\n<p>Reconstruction of Financial Assets and Enforcement of<\/p>\n<p>Security Interest Act, 2002 (SARFAESI Act). Consequent<\/p>\n<p>to failure in repayment of amounts availed by the<\/p>\n<p>petitioner from the respondent Bank under a cash credit<\/p>\n<p>facility, proceedings was initiated against the immovable<\/p>\n<p>property, which is the secured asset. The 3rd respondent<\/p>\n<p>had now issued Ext.P4 notice as contemplated under Rule<\/p>\n<p>8 (1) of the Security Interest (Enforcement Rules, 2002)<\/p>\n<p>intimating steps contemplated under Section 13 (4).<\/p>\n<p>      2.   It is noticed that the petitioner had not invoked<\/p>\n<p>any of the statutory remedies available at any stage of the<\/p>\n<p>proceedings. Hence considering the dictum laid by the<\/p>\n<p>Hon&#8217;ble apex court in United Bank of India Vs.<\/p>\n<p>Satyavati Tondon and others [2010 (8) SCC 110] it is<\/p>\n<p><span class=\"hidden_text\">                                2<\/span><br \/>\nWP(C) No. 34150\/2010<\/p>\n<p>not proper and justified for this Court to interfere with the<\/p>\n<p>proceedings invoking powers under Article 226.<\/p>\n<p>     3.     Having confronted with the above position, learned<\/p>\n<p>counsel for the petitioner submitted that the petitioner is<\/p>\n<p>relinquishing all challenges against the proceedings and that<\/p>\n<p>he is not intending to pursue any of the statutory remedies. On<\/p>\n<p>the other hand, prayer is only to permit the petitioner to pay off<\/p>\n<p>the entire liability in a phased manner within a reasonable<\/p>\n<p>time.\n<\/p>\n<p>     4.     Heard, learned standing counsel appearing for<\/p>\n<p>respondent Bank. It is submitted that there is an outstanding<\/p>\n<p>balance of around Rs.17.28 lakhs plus interest and incidental<\/p>\n<p>charges. It is further submitted that the cash credit facility<\/p>\n<p>remains overdrawn for a considerable period and the petitioner<\/p>\n<p>was not taking any effective steps to wipe off the liability.<\/p>\n<p>     5.     Having considered the facts and circumstances of the<\/p>\n<p>case, I am of the view that, eventhough interference on merits<\/p>\n<p>is not proper, indulgence can be shown in permitting the<\/p>\n<p><span class=\"hidden_text\">                                 3<\/span><br \/>\nWP(C) No. 34150\/2010<\/p>\n<p>petitioner to pay off the liability within a reasonable time in<\/p>\n<p>instalments.\n<\/p>\n<p>     6.     Accordingly, the Writ Petition is disposed of directing<\/p>\n<p>the respondents 1 to 3 to keep in abeyance all further coercive<\/p>\n<p>steps pursuant to the notices already issued, provided the<\/p>\n<p>petitioner remits the entire balance outstanding along with<\/p>\n<p>interest and expenses if any accruing, in 8 (eight) equal<\/p>\n<p>monthly instalments, falling due on or before 20.12.2010 and<\/p>\n<p>on or before the 20th day of the succeeding months.<\/p>\n<p>     7.     It is made clear that on the event of default in<\/p>\n<p>payment of any one of the instalments as stipulated above, the<\/p>\n<p>respondents will be free to proceed with further steps pursuant<\/p>\n<p>to notices already issued. It is also made clear that the relief<\/p>\n<p>granted above is subject to condition that the petitioner is<\/p>\n<p>precluded from raising any subsequent challenge against such<\/p>\n<p>proceedings.\n<\/p>\n<\/p>\n<p>                                    C.K.
