SIRI JAGAN, J.\n                - - - - - - - - - - - - - - - - - - - - - - -\n                     W.P.(C)No.11203 of 2010\n                - - - - - - - - - - - - - - - - - - - - - - -\n              Dated this the 19th day of May, 2010\n\n                           J U D G M E N T\n<\/pre>\n<p>     The petitioner participated in an auction for sale of<\/p>\n<p>sand from the catchment area of Malampuzha\/Chulliyar<\/p>\n<p>Dam. The tender was confirmed in his favour. He claims to<\/p>\n<p>have complied with the tender conditions for taking delivery<\/p>\n<p>of the sand. While matters stood so, fresh tenders were<\/p>\n<p>invited by Ext.P9 which according to the petitioner is in<\/p>\n<p>respect of the same subject matter. The petitioner contends<\/p>\n<p>that it is illegal to invite fresh tenders after confirming the<\/p>\n<p>earlier tender in favour of the petitioner. It is under the<\/p>\n<p>above circumstances the petitioner has filed this writ<\/p>\n<p>petition seeking the following reliefs:<\/p>\n<blockquote><p>     i)    To call for the records leading upto Exhibit P9 and quash<br \/>\n           the same by the issuance of a Writ of Certiorari or any<br \/>\n           other appropriate writ, order or direction.\n<\/p><\/blockquote>\n<blockquote><p>     ii)   In the alternative, to permit the petitioner to participate<br \/>\n           in the new tender after cancelling first tender and<br \/>\n           refunding him all the monies already remitted by him.\n<\/p><\/blockquote>\n<p>W.P.(C)No.11203 of 2010<br \/>\n<span class=\"hidden_text\">                                    -2-<\/span><\/p>\n<p>      iii)  To declare that the entire procedure adopted by the<br \/>\n            respondents are violative of Articles 14, 19 and 21 of the<br \/>\n            Constitution of India.\n<\/p>\n<p>      iv)   To issue such other writs, orders or directions as this<br \/>\n            Hon&#8217;ble court may deem fit and proper in the<br \/>\n            circumstances of the case.\n<\/p>\n<\/p>\n<p>      2.    The learned Government Pleader appearing on<\/p>\n<p>behalf of respondents submits that Ext.P8 &amp; P9 are in<\/p>\n<p>respect of different items and the sand for which the<\/p>\n<p>petitioner has submitted tender would be handed over to<\/p>\n<p>him if the petitioner complies with all the tender conditions<\/p>\n<p>in time.     The said submission is recorded. In the above<\/p>\n<p>circumstances nothing survive in this writ petition.<\/p>\n<p>Accordingly the writ petition is closed with the above<\/p>\n<p>direction.\n<\/p>\n<\/p>\n<p>                                                          S.
