M. SAHAI)<\/p>\n<p>This<\/a><br \/>\n\tappeal has been filed challenging the order dated 25.01.2011 passed<br \/>\n\tby the learned Single Judge in Special Civil Application No.14586 of<br \/>\n\t2010.\n<\/p>\n<p>The<br \/>\n\trespondent &#8211; workman asked for a copy of the Muster Roll under<br \/>\n\tthe Right to Information Act which he filed before the Labour Court<br \/>\n\tas Exh.42 &amp; 44 to establish that he worked for 240 days in the<br \/>\n\tpreceding 12 months from the date of termination.  The Labour Court<br \/>\n\thas not awarded back wages but ordered reinstatement. Therefore, the<br \/>\n\tlearned Single Judge upheld the award passed<br \/>\n\tby the Labour Court.\n<\/p>\n<p>\tThe<br \/>\n\ttwo Courts have recorded concurrent finding of fact that the<br \/>\n\trespondent workman has worked for a period of 240 days and the<br \/>\n\ttermination order was illegal.\n<\/p>\n<p>\tWe<br \/>\n\tdo not find any illegality in the impugned order passed by the<br \/>\n\tlearned Single Judge or by the Labour Court.  This appeal fails and<br \/>\n\tis accordingly dismissed.\n<\/p>\n<p>In<br \/>\n\tview of dismissal of appeal, Civil Application does not survive and<br \/>\n\tit is accordingly dismissed.\tSd\/-\n<\/p>\n<blockquote><p>\t\t\t\t\t\t\t\t[V.
