S.J. MUKHOPADHAYA)<\/p>\n<p>1\tIn<br \/>\nthe departmental inquiry, the appellant having been found guilty to<br \/>\ncause loss to the State exchequer to the tune of Rs.5,95,702 on<br \/>\naccount of his negligence, the respondent-authority imposed penalty<br \/>\nof deduction of Rs.500\/- per month from the pension of the appellant<br \/>\nfor a period of five years. The learned Single Judge having noticed<br \/>\nthe aforesaid fact of recovery to the extent of Rs.30,000\/- dismissed<br \/>\nthe writ petition, giving rise to the present appeal.\n<\/p>\n<p>2\tThe<br \/>\nbrief facts of the case are that the appellant was working as Office<br \/>\nSuperintendent under the respondents. He was served with chargesheet<br \/>\non 24th January 2006 on two grounds, namely,<\/p>\n<p>[i]\twhile<br \/>\nhe was holding the additional charge of the post of \tAdministrative<br \/>\nOfficer on 1st June 2002, an amount of Rs.5,95,702 \twas<br \/>\nstolen by some one; and<\/p>\n<p>[ii]\tthe<br \/>\nappellant misappropriated money by \twithdrawing his salary \tbefore<br \/>\nthe date of payment.\n<\/p>\n<p>3\tThe<br \/>\nInquiry Officer conducted inquiry giving opportunity to the appellant<br \/>\nand by his report dated 4th June 2007 held that charge<br \/>\nNo.1 is proved against the appellant and further held that charge<br \/>\nNo.2 was not found proved. A copy of the inquiry report has been<br \/>\nforwarded to the appellant by letter dated 6th June 2007<br \/>\nasking him to make representation and on receipt of representation<br \/>\ndated 18th June 2007, the authorities imposed penalty of<br \/>\nreduction in pay by five stages upto the date of superannuation on<br \/>\n31st August 2008 with effect from 1st August<br \/>\n2007.\n<\/p>\n<p>4\tThe<br \/>\nappellant challenged the aforesaid order before the Gujarat Civil<br \/>\nServices Tribunal, Gandhinagar, in Appeal No.285 of 2007 and by order<br \/>\ndated 23rd June 2008 the Tribunal   set aside the order<br \/>\ndated 7th July 2007  and remitted matter to the authority.<br \/>\nSubsequently, the appellant having retired superannuated on 31st<br \/>\nAugust 2008. When the matter was taken up,  the appellant having been<br \/>\nfound guilty of the first charge of loss to State exchequer of<br \/>\nRs.5.95,702\/-, in terms of the pension rules, the Authority imposed<br \/>\npenalty of deduction of Rs.500\/- per month from the pension of the<br \/>\nappellant for a period of five years.\n<\/p>\n<p>5\tLearned<br \/>\ncounsel appearing on behalf of appellant would submit that  the<br \/>\npenalty is more harsh than the earlier one as was imposed, but such<br \/>\nsubmission cannot be accepted. As earlier the punishment was imposed<br \/>\nas per the disciplinary rules and after the retirement as the<br \/>\nauthority was not empowered to impose any punishment, they passed<br \/>\norder under the pension rules reducing the pension, it will be a<br \/>\nmeagre part of the total loss to the State exchequer. We find no<br \/>\nground made out to interfere with the order passed by the learned<br \/>\nSingle Judge.
