Justice R.BASANT\n\n Dated :11\/03\/2008\n\n O R D E R\n                              R.BASANT, J\n                      ------------------------------------\n                       B.A.No.1410 of 2008\n                      -------------------------------------\n              Dated this the 11th day of March, 2008\n\n                                  ORDER\n<\/pre>\n<p>      Application for anticipatory bail. Petitioner is an employee<\/p>\n<p>of the Alangadu Grama panchayat. He had allegedly received an<\/p>\n<p>amount of Rs.6,848\/- from one Divya Kumar Jain and had issued a<\/p>\n<p>receipt for the said amount to his an agent. Though the copy of<\/p>\n<p>the receipt handed over to the party showed that an amount of<\/p>\n<p>Rs.6,848\/- has been received, the original kept in the office only<\/p>\n<p>showed that an amount of Rs.15\/- had been received. Only that<\/p>\n<p>amount was brought into the accounts of the panchayat. The<\/p>\n<p>offence was detected.          Action was initiated.            Ultimately a<\/p>\n<p>complaint was filed before the police.                  Crime has accordingly<\/p>\n<p>been registered on 14.02.08. Investigation is in progress. The<\/p>\n<p>petitioner apprehends imminent arrest.\n<\/p>\n<p>      2.   The learned counsel for the petitioner submits that the<\/p>\n<p>petitioner is innocent.     Only an amount of Rs.15\/- had been<\/p>\n<p>received. The petitioner is not responsible for the alteration of<\/p>\n<p>the copy retained by the party. In any view of the matter, the<\/p>\n<p>petitioner does not deserve to endure the trauma of arrest and<\/p>\n<p>detention. He may be granted anticipatory bail, it is prayed.<\/p>\n<p>      3.   The learned Public Prosecutor opposes the application.<\/p>\n<p>The learned Public Prosecutor             submits that all the available<\/p>\n<p>indications clearly show the complicity of the petitioner. In any<\/p>\n<p><span class=\"hidden_text\">B.A.No.1410 of 2008                2<\/span><\/p>\n<p>view of the matter, the petitioner does not deserve the invocation<\/p>\n<p>of the extraordinary equitable discretion under Section 438<\/p>\n<p>Cr.P.C.\n<\/p>\n<p>     4.    I have considered all the relevant inputs.           I have<\/p>\n<p>perused the case diary. Copies of the original receipt as well as<\/p>\n<p>the receipt issued to the party are available in the case diary. The<\/p>\n<p>case diary statement of the person who allegedly made the<\/p>\n<p>payment and obtained the receipt has also been perused by me.<\/p>\n<p>Having considered all the relevant inputs, I am not persuaded to<\/p>\n<p>agree that any circumstances exist in this case which can justify<\/p>\n<p>or warrant the invocation of the extraordinary equitable discretion<\/p>\n<p>under Section 438 Cr.P.C. This, I am satisfied, is a fit case where<\/p>\n<p>the petitioner must appear before the Investigating Officer or the<\/p>\n<p>learned Magistrate having jurisdiction and then seek regular bail.<\/p>\n<p>     5.
