ANAND.\n\n\nPresent :   Mr. Gagan Pradeep S. Bal, Advocate,\n            for the petitioner.\n\n                                 ****\n<\/pre>\n<p>S.D. Anand, J (Oral).\n<\/p>\n<p>            The petitioner &#8211; prisoner applied for parole in order to<\/p>\n<p>be able to attend the marriage of his nephew (sister&#8217;s son) to be<\/p>\n<p>solemnized on 07.12.2008.\n<\/p>\n<p>            Notice of motion.\n<\/p>\n<p>            On the asking of the Court, Ms. Manjari Nehru, Deputy<\/p>\n<p>Advocate General, Punjab, accepts notice on behalf of the State.<\/p>\n<p>            The petition shall stand disposed of accordingly with<\/p>\n<p>the following directions to the Competent Authority:-<\/p>\n<blockquote><p>     a)     The respondents shall ascertain the correctness or<\/p>\n<p>            otherwise of the averment made by the petitioner;<br \/>\n<span class=\"hidden_text\"> Crl. Misc. No. M-31504 of 2008                                    2<\/span><\/p>\n<\/blockquote>\n<blockquote><p>      b)     If the factual averment is found to be correct, the<\/p>\n<p>             petitioner shall be released on parole for a reasonable<\/p>\n<p>             period to enable him to attend the marriage of his<\/p>\n<p>             nephew to be solemnized on 07.12.2008. If the<\/p>\n<p>             averment is found to be factually incorrect, the<\/p>\n<p>             Competent Authority may pass an order to the<\/p>\n<p>             contrary. The release shall, of course, be subject to the<\/p>\n<p>             furnishing of adequate surety etc. by the petitioner &#8211;<\/p>\n<p>             prisoner.\n<\/p><\/blockquote>\n<blockquote><p>      c)     The exercise shall be concluded within a period of two<\/p>\n<p>             days from today.<\/p><\/blockquote>\n<p>             It will be for the State counsel to communicate the<\/p>\n<p>order to the Competent Authority.\n<\/p>\n<p>             Copy of the order be given to the learned State counsel<\/p>\n<p>under the signatures of the Court Secretary.<\/p>\n<pre>December 01, 2008                                     ( S.D.
