P.\n\n\n03\/23.09.2011<\/pre>\n<p>             Heard learned counsel for the petitioner and learned<br \/>\n                  counsel for the State.\n<\/p>\n<p>                                The petitioner is apprehending his arrest in connection<br \/>\n                  with the case registered under Section 379 of the Indian Penal<br \/>\n                  Code.\n<\/p>\n<p>                                Learned counsel for the petitioner submits that one<br \/>\n                  mobile phone has been recovered from his brother-in-law which is<br \/>\n                  theft article and the said brother-in-law has stated about the<br \/>\n                  petitioner that he has got this mobile from the petitioner. It is<br \/>\n                  contended that there is family dispute between the brother-in-law<br \/>\n                  of the petitioner and petitioner, therefore, petitioner has been<br \/>\n                  implicated in this case. It is also contended that the petitioner is a<br \/>\n                  police constable and he is in service of G.R.P. at Dhanbad. It is<br \/>\n                  also submitted that the informant is also a police constable who is<br \/>\n                  residing in the same barack.\n<\/p>\n<p>                                Considering the facts and circumstances of the case,<br \/>\n                  the petitioner, above named, is directed to surrender in the court<br \/>\n                  below within a period of one month from the date of this order i.e.<br \/>\n                  23.09.2011 and in the event of his surrender, the trial Court is<br \/>\n                  directed to release him on bail, on furnishing bail bond of Rs.<br \/>\n                  10,000\/- (Rs. Ten thousand) with two sureties of like amount each<br \/>\n                  to the satisfaction of Chief Judicial Magistrate, Dhanbad in<br \/>\n                  connection     with   Dhanbad    P.S.   Case   No.   850    of     2010<br \/>\n                  corresponding to G.R.
