Amendment be carried out forthwith.\n<\/p>\n<p>The<br \/>\n\t petitioner  has  been  detained under the provisions   of   Gujarat<br \/>\n\t  Prevention of Anti-Social Activities Act, 1985 (hereinafter<br \/>\n\treferred to as `the Act of 1985&#8242;) by the  order dated  10-9-2009<br \/>\n\tpassed by the District Magistrate, Bhavnagar District, Bhavnagar,<br \/>\n\tand he has been declared as bootlegger.\n<\/p>\n<p>Heard<br \/>\n\tlearned advocate for the petitioner and the learned AGP for the<br \/>\n\tState.    Also  perused the  record.\n<\/p>\n<p>It<br \/>\n\tappears that one offence being Gadhda Police Station Crime Register<br \/>\n\tNo.118 of 2009 dated 13-8-2009 under the prohibition Act has been<br \/>\n\tregistered against the detenue  alleging that 41 bottles of foreign<br \/>\n\tliquor costing Rs.12,300\/- were found from the possession of the<br \/>\n\tdetenu. On the basis of registration of the said case, the detaining<br \/>\n\tauthority held that since the said activities of selling country<br \/>\n\tmade liquor of the present detenu were harmful to the health of the<br \/>\n\tpublic, to restrain him from carrying further illegal activities, he<br \/>\n\thas been detained. It appears from the order that the activities of<br \/>\n\tthe detenu cannot be said to be disturbing the  public order .<br \/>\n\tIt also appears from the order passed by the detaining authority<br \/>\n\tthat  grounds which are mentioned in the order are in reference to<br \/>\n\tthe situation of  law and order  and not  public order .<br \/>\n\tTherefore, on this ground, the subjective satisfaction arrived at by<br \/>\n\tthe detaining authority is vitiated on account of non-application of<br \/>\n\tmind and the impugned order, therefore, deserves to be quashed and<br \/>\n\tset aside.\n<\/p>\n<p>Except<br \/>\n\tthe statements of some anonymous witnesses, there is no material on<br \/>\n\trecord which shows that the detenu is carrying on activities of<br \/>\n\tselling country made liquor which is harmful to the health of the<br \/>\n\tpublic. In the case of Ashokbhai Jivraj @ <a href=\"\/doc\/687998\/\">Jivabhai Solanki v.<br \/>\n\tPolice Commissioner, Surat<\/a> [(2001) (1) GLH 393), having<br \/>\n\tconsidered the decision of the Hon&#8217;ble Apex Court in the case of Ram<br \/>\n\tManohar Lohia v. State of Bihar (AIR 1966 SC 740), this Court<br \/>\n\theld that the case wherein the detention order passed on the basis<br \/>\n\tof the statements of the witnesses fall under the maintenance of<br \/>\n\t law and order  and not  public order .\n<\/p>\n<p>Applying<br \/>\n\tthe ratio of the above decisions, it is clear that before passing an<br \/>\n\torder of detention of a detenu, the detaining authority must come to<br \/>\n\ta definite finding that there is threat to the  public order<br \/>\n\tand it is very clear that the present case would not fall within the<br \/>\n\tcategory of threat to  public order . In that view of the<br \/>\n\tmatter, when the order of detention has been passed by the detaining<br \/>\n\tauthority without having adequate grounds for passing the said<br \/>\n\torder, it cannot be sustained and, therefore, it deserves to be<br \/>\n\tquashed and set aside.\n<\/p>\n<p>The<br \/>\n\tpetition is allowed. The impugned order of detention dated 10-9-2009<br \/>\n\tpassed by the District Magistrate, Bhavnagar District, Bhavnagar,<br \/>\n\tpassed  against  the detenu is hereby quashed and set  aside.   The<br \/>\n\tdetenu is ordered to be set at liberty forthwith,  if  not  required<br \/>\n\t in  any other case.    Rule is made absolute accordingly.
