     The petitioner was appointed as an Air Craftsman<\/p>\n
(Technical) in the Indian Air Force on 31.12.1987. His original<\/p>\n
engagement in the Air Force was for 20 years. But he sought<\/p>\n
for premature discharge and it was granted to him as<\/p>\n
evidenced by Exhibit P1 order with effect from 31.3.2001.<\/p>\n
Exhibit P1 shows that at the time of the discharge of the<\/p>\n
petitioner he had rendered 13 years and 3 months’ service.<\/p>\n
The reasons for his discharge is given as “at his own request<\/p>\n
before fulfilling the conditions of his engagement”.        It is<\/p>\n
further shown that he had reserve liability of two years.<\/p>\n
     2.   Petitioner then applied for pension which was<\/p>\n
rejected under Exhibit P6 order wherein     it is stated that the<\/p>\n
petitioner was enrolled in the Indian Air Force on 31.12.1987<\/p>\n
and discharged from service on 31.3.2001 at his own request<\/p>\n
before fulfilling the conditions of his enrollment.       As per<\/p>\n
Regulation 121 of the Pension Regulations for the Air Force,<\/p>\n
W.P(C) NO. 16720 OF 2008<\/p>\n
                              -: 2 :-<\/span><\/p>\n
1961, the minimum required qualifying service to earn service<\/p>\n
pension is 15 years and therefore petitioner is not eligible for<\/p>\n
grant of service pension.     That has been challenged in this<\/p>\n
Writ Petition.\n<\/p>\n
      3.   A statement       has been filed by the Central<\/p>\n
Government Standing Counsel on behalf of the respondents.<\/p>\n
It is contended that the petitioner’s period of engagement<\/p>\n
was 20 years regular and 6 years reserve. Thus the petitioner<\/p>\n
does not fall under the category of reserve since the petitioner<\/p>\n
had been prematurely discharged from service on his own<\/p>\n
request. The qualifying services considered by this Court in<\/p>\n
Exhibits P2 to     P4 judgments were in relation to     persons<\/p>\n
whose period of engagement was less then 20 years. That is<\/p>\n
not the case of the petitioner.\n<\/p>\n
      4.   A reply affidavit has been filed by the petitioner. I<\/p>\n
heard the learned counsel for the petitioner and learned<\/p>\n
Central Government Standing Counsel on behalf of the<\/p>\n
respondents.\n<\/p>\n
      5.   Regulations 136(b) and 137 of the Air Force Pension<\/p>\n
Regulations are referred to by the petitioner. Therefore, they<\/p>\n

are extracted hereunder.\n<\/p>\n
                 “136. (a) …………\n<\/p><\/blockquote>\n
                  136(b)    A reservist who is not in<\/p>\n
           receipt of a service pension and whose<\/p>\n
           period of engagement for regular service<\/p>\n
           was extended, and whose qualifying<\/p>\n
           service is less than the total period of<\/p>\n
           engagement but not less than 15 years<\/p>\n
           may, on completion of the period of<\/p>\n
           engagement or on earlier discharge from<\/p>\n
           the reserve for any cause other than at<\/p>\n
           his own request, be granted a reservist<\/p>\n
           pension at the above rate of or the<\/p>\n
           gratuity in lieu.\n<\/p><\/blockquote>\n
                 137.       An     individual  who   is<\/p>\n
           prematurely transferred to the reserve<\/p>\n
           under the regulations may be granted the<\/p>\n
           reservist pension irrespective of the<\/p>\n
           period     of regular      service rendered,<\/p>\n
           provided he has completed, on discharge,<\/p>\n
           the period of combined regular and<\/p>\n
           reserve service according to the terms of<\/p>\n
           his engagement and the entire service is<\/p>\n
           qualifying”.\n<\/p><\/blockquote>\n

     6.    Regulation 136(b) is not, obviously, applicable to<\/p>\n
the case of the petitioner. Because, admittedly, his discharge<\/p>\n
from service was on his own request. The contention of the<\/p>\n
petitioner on the basis of    Regulation 136(b) is, therefore,<\/p>\n
untenable.\n<\/p>\n
     7.    On a reading of Exhibit P6, it seems that the<\/p>\n
petitioner had only requested for regular pension, by<\/p>\n
contending that the period of reserve service of two years<\/p>\n
must be added to the period of his regular service. That was<\/p>\n
rejected on a reference to       Regulation 121 of      Pension<\/p>\n
Regulations for the Air Force, 1961 and to that extent the<\/p>\n
stand taken in Exhibit P6 is correct. If that be so, it does not<\/p>\n
warrant any interference.\n<\/p>\n
     8.    Petitioner seems to have developed a case for<\/p>\n
reservist pension only at the stage of the Writ Petition and<\/p>\n
therefore the respondents cannot be found fault with for not<\/p>\n
considering the petitioner’s claim      and deciding it with<\/p>\n
reference to the Pension Regulations. But since the petitioner<\/p>\n
has now raised a claim under Regulation 137 of the Pension<\/p>\n
Regulations, it would be appropriate that the competent<\/p>\n

authority considers the petitioner’s case in terms of<\/p>\n
Regulation 137 of the Pension Regulations.<\/p>\n
     In the result, the Writ Petition is disposed of directing<\/p>\n
the 4th    respondent to consider the petitioner’s claim for<\/p>\n
reservist pension under Regulation 137 of the Pension<\/p>\n
Regulations for the Air Force and pass appropriate orders<\/p>\n
within a period of six months from the date of receipt of a<\/p>\n
copy of this judgment. Petitioner may produce a copy of the<\/p>\n
judgment before the 4th respondent for compliance.<\/p>\n
